anti-trust tobacco suit which will be ar-
gued next week In that court The eases
were tried In the United States circuit
court for the Southern district of New
York which after dismissing: the peti-
tion as to foreign tobacco companies and
some of the subordinate American com-
panies adjudged the others to be parties
to an unlawful conspiracy and enjoined
them from' continuing their operations
and ' from 1 engaging in Interstate corn-
mere. The attorney general takes the position
that these findings sweeping as they
seem to have been were not broad
enough and he asked the supreme court
to So extend them as to widen their scope
and take In the foreign companies and
some Individuals who were relieved from
the operation of the verdict. Many other
extensions of the Judgment are also re-

combined assets amount to $400000000. It
la asserted that the combination manu-
facturers all of the cigarettes for export
and almost three-fourths of the smoking
tobacco and cigarettes for domestic sale
more than three-fourths of the plug twist
and fine-cut tobacco and almost all of
the snuft and little cigars that are made.
It la declared that the "defendants per-
sistently have exercised duress have
practiced wicked and unfair methods and
used their great power In oppressive
ways."
Further It is asserted that they have
been actuated by a fixed purpose to de-
stroy competition and obtain monopolies.
Competitors have disappeared gradually
and the combination now strongly en-
trenched unduly restricts the business
of those in the trade and prevents others
from entering.
VIOLATED COMMON LAW.
Putting aside for the time the effect
of the Sherman anti-trust law under
Mrhtah the suit was brought It is con-
tended that the combination under the
namjP of the American Tobacco compa-
ny was illegal when It was entered into
' In 1890 because it was contrary to com-
mon law. Contending for the right of
- congress to enact anti-trust legislation
;' it Is asserted that the essettlal purpose
Of the Sherman law Is to prevent injury
and not merely td reverse a course of
. conduct. The attorney general also lays
down the general proposition that "the
' right freely to buy sell and transfer
property Is not a fundamental oivll right
to be exercised without limitation as ln-
V ' terested parties may determine" and he
adds the assertion that "It Is subordinate
to publlo policy and the lawfully express
:... ad will of officers."

WASHINGTON December $0. Repre-
sentative Slma of Tenneaaee la preparing
to support his action In co-operating with
the solid republican membership of the
committee on Interstate and foreign com-
merce In making a favorable report on
the Mann bill for the suppression of the
"white slave" ttafflc. This bill will be
considered In the house early In. January.
Representatives Slma' Russell and Peters
democrats are supporting the Mann bill
while Adanuon and Bartlett of Georgia
and Richardson of Alabama democrats
are opposing It and will voice their op-
position In a vigorous minority report.
BILL WILL "STAND TEST.
Mr. Sims said today that while there
may be some doubt as to the constitu-
tionality of some sections of the Mann
bill that as a whole he la convinced that
the act will stand the test of the courts.
He said the report of the joint commis-
sion of the house and aenate made short-
ly before the adjournment for the Chrtat-
maa holidays ahowed that tne "white
slave" traffic was on the Increase and
that many hundreds of alien women and
girls are being brought to this country
from Europe and Asia for Immoral pur
poses. They are virtually slaves con-
tinued Mr. Slma. ' and the procurers ' and
Importers of these white slaves often re-
ceive as high price ror a woman' or girl
aa was paid for a negro prior to the dvlt
war. .
FEDERAL ACTION NEEDED.
Mr. Sims says the States acting Inde-
pendently are powerless to break up this
unholy traffic and that nothing less than
the supplementary aid of the National
government can put an end to It. He
does not regard the Mann bill as usurp-
ing the police power of the States any
more than the National quarantine bill
does; that if the Mann bill Is of doubtful
constitutionality he Is willing to solve
the doubt in favor of public health and
moral a Mr. Biros wlU endeavor to carry
a majority of the democrata of the house
In support of the Mann bill and todlca-.
tlona are he will succeed.
There Is nothing In the Mann bill that
relates to peonage.
