TEXARKANA. Texas. Feb. 13-
The "battle of legal witaesaes prepare
tory to pleadings pf the defendant a in
the ao-called oil fraud cases growing
out of operations of oil promoters in
the Smsckover and El Dorado oil
fields started in federal court he-ie
today with presentation of motions
and responses to Judge r . A. 1 oil-
man of the Weatern district of Ar-
kansas. The "Pat" Marr case was taken up
first. Marr. rated at one time aa the
biggest producer in Smarkover "won-
der ' oil field through hia attorney
W. H. Martin of Hot Springe pre-
sented two petitions. One waa a plea
in abatement. Becking to have the in-
dictment dismissed because of alleged
illegal acts of government agents and
the other sought permission to inter-
view the members of the grand jury
which returned the indictment and to
inspect the minutes; also to have a
list of the witnesses appearing before
the grand jury furnished his attor-
neys so that they could be questioned.
Mr. Martin contended in hia plea in
abatement that Marr'a Indictment waa
illegal because government agents il-
legally had searched and seised Marr'a
records in his El Dorado office.
' The government's response was a
sweeping denial to alt of the allega-
tions. In his second petition Mr. Martin
said that in order to prove the con-
tentions in his plea in abatement it
was necessary to- interview members
of the grand .jury and the witnesses
appearing in the Marr case.
J. D. Shaver special assistant dis-
trict attorney announced that the
government would contest the petition
and time waa given to prepare the
answer.
A motion to quash the indictment
of Robert Edmond Ingalls Gordon In-
galla Kenneth W. Forbes. Roy Baker
and John Dashko on account of in-
competent evidence was filed by their
attorneys. .
INSPECT NEGRO SCHOOL.
RUSK. Texas Feb. 13. G. T. Blud-
worth special rural school agent of
the department of education was in
the county today and in company with
County Superintendent W. B. Thomp-
aon inspected the Bradford Risen-
wald school in consolidated common
achool district No. 2 This is the
twelfth Rosenwald school house that
has been finished in Cherokee county

KILGORE Texas Feb. 13. A pe-
culiar reason for failure of Kilgore's
electric lights was revealed Monday
morning when it became known that
one of the poles used to support the
wires was snapped off near the
ground in an automobile accident. A
negro was driving his car along the
highway near Body switch and ran
into the pole breaking it off near the
? round. The town waa in darkneaa
or several hours.
FIND POTASH SALT
DEPOSITS IN TEXAS
COLORADO. Texaa. Feb. 13 In-
troduction of a bill iu the United
mates senate by Senator Morris
Sheppard. asking an appropriation for
the development of potash in West
Texas has caused considerable In-
terest and enthusiasm here. Potash
ia known to exist in the western part
of Mitchell county and apecimens
taken from oil wells in the vicinity
of Weatbrook have been found tc
contain from 10 to 13 per cent of the
mineral Vhen analysed.
Kvidenoea of potash have been
found in every well drilled in the
county the deposits being 1000 feet
or more below the surface. Reports
on specimens examined by the Univer-
sity of Texas geologists and the de-
partment of mines at Washington
are said to have been favorable. It
ia the belief of Colorado oil men that
potash could be successfully commer-
cialised here aa the mineral bearing
stratum baa been found to be sev
eral feet in thickness.
Underlying thla section ia also what
is said to be one of the most valuable
deposits of rock salt ever found in the
Southwest The deposit which 1
pure crystal and several feet in diam-
eter is found at a depth of from
1200 to 1500 feet. Through the ef
forts of the West Texaa chamber of
commerce attempts are new being
made to interest capitaliats ia thia
mineral. Two large aalt work a were
formerly operated near here one of
them burned down and the other
closed down on account of high prices
of fuel. With the discovery of oil
nearby It ia believed the aalt industry
can be revived.
