Russell oE Tyler who ljas represent-
ed the Third Texas district in con
gress since 1902 was today nominat
ed by President Taft as judge of the
United States court for the Eastern
District of Texas to succeed the late
D E Bryant of Sherman Mr Rus-
sell will resign his seat in congress
on the day he is confirmed by the
senate and win prepare immediately
to assume the duties of the new ju-
dicial position to which he has been
appointed The indications are that
his confirmation will come within a
week as no lritchjs expected to arise
The earlj resignation will open a
doublebarrel congressional campaign
in the Third District as the primary
ticket will carry a nomination for the
short unexpired term and also a nom-
ination for the sixtythird session of
congress unless the governor should
decide to call a special election to
fill the unexpired term It is expect-
ed here however that the nomination
for the unexpired and the next reg-
ular term will be made on the same
ballot in the July primaries
The long delay on the part of Presi
dent Taft in making known his selec
tion for the East Texas judgeship has
produced a nervous uncertainty amone
the available congressonal timber in
the Third Texas pistrict Some six
possible candidates for congress have
been anxious to learn of Mr Russells
fate before June C in order to get
their names on the ballot in the event
that Mr Russell did not stand for re
election Besides H C Geddie of
Mineola who has already announced
for congress it is understood here
that R W Simpson of Gilmer pres-
ent district judge of that district and
J H Beavers district attorney for
the same district will both be candi-
dates t o succeed Representative Rus-
sell Others who it Is thought may
enter the race are James J Faulk of
Athens C E Gilmore of Wills Point
R T Brown of Henderson and James
Young of Kaufman
Friends of J R Blades of Van
Zandt who has served as secreatry to
Representative Russell for several
years are urging him to become a
candidate for the office but Mr
Blades has not yet decided the mat

joy to his colleagues on both sides of
the chamber In the house both demo-
cratic and republican leaders extend-
ing their congratulations His col-
leagues on the interstate commerce
committee were especially jubilant at
his success though regretful of the
loss of his services on that important
committee Members of the Texas
delegation have already started a
movement in behalf of Representative
W R Smith of Colorado City to suc-
ceed Representative Russell on the
ways and means committee Judge
Smith ranks among the best lawyers
on the democratic side of the house

public officer and had to keep his
mouth shut but Mr Johnson declared
this was a new doctrine to him he
had never heard before that a mans
person political and official conduct
could be bitterly attacked and yet
there could be no defense because he
was an officeholder
Are we going to thrash out the
Bailey issue again in all of its dej
to dig up all the facts connected with
that matter and debate them over
Texas and put the great issues that
baiting his arepleading for settlement into the
background and shove thems into a
corner
Some of the candidates for gover-
nor are trying to ride thisissue and
to use it as a stepping stone to their
ambition There is Colquitl Though
everybody knows that he was un-
friendly to Bailey as soon as he
made his opening speech he lit out
for Gainesville and there fell down
in the dust and apologized and said
that Bailey was the greatest living
exponent of democracy and now says
that he is for Bailey for senator
when he runs against the field We
all know what this is for What dif-
ference did it make whether Colquitt
was for or against Bailey in deciding
his availability as a candidate for gov-
ernor It is what he stands for and
what he stands against that he ought
to be ested by and not by his ability
to cover Bailey with fulsome flat
