The decision of the Philadelphia;
district court holUing it a felony to
purchase illegal liquor if the buyer
is a party to the transportation of
the intoxicant can have a far-reach-
ing effect as an aid to enforcement.
In Texas, as in a few other States
with stringent local liquor laws, the
ruling has no immediate effect ex-
cept in increasing the liability to
prosecution under Federal indictment.
For, in these few States, possession
is in itself a felony, and possession is'
proved with greater facility than con-
spiracy to transport.
The efficiency of the decision in
Federal enforcement, however, may
lie in its use as a threat rather than
in actual application. It should cre-
ate an instant unpopularity in the use
f. foreign labels, since the trade marl:
of “Johnny Walker,” “DeW'ar,”
“Canadian Club’” and other imported
brands may be interpreted as a warn-
ing to the purchaser that the vendor
has transported the liquor and there-
by make him a party to conspiracy
in the carriage. Possession might
thus make the purchaser liable to
