WUERE.S John H. Sterrctt a citizen of the county
of Hams In the State of Texas has by his At-
torney Benjamin C. Franklin filed bis petition and insti-
tuted suit In the District Court of Jefferson County sgalnat
Johb A. Veatch upon a certain writing obligatory in the
words following to wit :

I firmly bound to John II. Sterreil in the sum of one thou-
I John A. Veatch of the County aforesaid am held and
onlr bound to John H. Sterreil in the sum of one thou
sand dollars for the payment of which well and truly u
be made I bind myself my heirs administrators and as
signs firmly by these presents
fciKned with my signature and scrawl by wsy of seal
this twenty-second day of July A. D. 1845.
The condition of the obligation is a follows to wit :
Whereas the said bounden John A. Vealch has told to
the said Slerrett six hundred and forty acres of land to be
selected by said Sterrett off of any portion of a tract of
land lying in the County uf Jefferson and Republic afore-
said and titled lo Sbaduch Morris by George Antonio
Nixon and bv said Morris sold to the said Vealch: aald
J tract containing seventeen hundred and thirty-eight acres:
provided said section shall not be made so as to intericre
with a tract of six hundred and forty acres of land hereto-
fore sold by the said Veatch to one Parke. Now If the
said bounden Veatch ekall make to the saidterrett his
heirs or assigns a guouand valid title to said land when
selected as aforesaid and duly defined then and in that
case this obligation lo be void otherwise to remain id
full force and effect.

Which said bond has been duly proved by one of the
subscribing witnesses before the Clerk of the County
Court of Payette County anlheSiate of Texas and duly
recorded In the office of the Clerk of the County Court of
Jeflerson County book76Lages 06 and 97 which said
bond marked A is annexed to and made a part or Plain-
tiff's petition in said suit; and petitioner alkdges that he
did select and procure the said six hundred and forty acres
to be surveyed and designated In compliance with raid
bond. A copy o the filed notes is attached to and made
part of the Plaintiff's petition and marked B. Plaintiff
alledges In his petition that be paid "ie said John A. Veatch
the sum of one thousand dollars ""Hi that said Veatch hu
wholly failed and refused to inakthc title to said land in
accordanco with the tenor of said bond to hia eah plain-
tiff's damage in the sum of two thousand dollars and oath
having been made by the said Attorney that John 'ohn.
A. Veatch Is not a resident within the limits of this State.
Yon are therefore hereby commanded to cite the afore-
said John A. Veatch by making publicatlc-s of this cita-
tion In some newspaper published In the County of Gal-
veston there being no newspaper published In the County
of Jefferson for four successive weeks previous b he re.
turn day of this citation lo be and appear at the rtnet
Court in and for the County of Jefferson to be Loiden
in the Court-house thereof in the town of Beaumont os
the fifth Monday after the fourth Monday or September
A-D. 1851 and answer said petition.
