The opinion of the Court was delivered by
Hemphill Ch. Jus.
The plaintiff Able.claimaof the dcfenJnnt

price of a hone iclil to defendant on the first
of January 1S41. Ai Uie only point in the
case arise oo the exclusion of an lntcrrosato-
ry to and the answer of n witness I wilt elate
that the effect of this delusion may he under-
stood the substance adduced nt the trial.
The plaintiff proved by the witness John
Able that he had sold the horse to the de-
fendant some time in 1S40 or the early part
ot 1841 for five hundred dollars that shortly
niter the commencement of the suit witness
heard defendant cay that the plaintiff had
sued him for more tli.ni defendant owed him
that he did not on c him more than two hun-
dred and fifty doILi S and not that on a just
settlement. The answer of James Cool. the
interrogatories were then offered in evidence.
He stated that the defendant had bought the
horse and had admitted to the witness that he
was to pay five hundred dollars.
The third interrogatory and the answer
were excluded ; they were expressed as fol-
lows: "Did you ever hear the defendant
(Sparks) state that he did or did not one me
any thing on account of the horse mentioned
in the foregoing interrogatory and if so state
what he said upon the subject and when and
whether before or niter the commencement
of this suit. Answer Sparks told me that

than two hundred and fifty dollars on said
horse. The time of the conversation between
myself and William C. Sparks as above
stated. I do not recollect though it was about
the time or after the institution of the raid
sniit by the said able agninn Sparks." The
defendant proved by a witness named Spen-
cer that he came to Texas in 1840 that the
horse was then in possession of Sparks that
shortly after plaintiff told him that he owned
one-half of said horse and offered to edl hii
half to witness sometime afterward plaintiff
told witness he had sold his interest in said
horse to defendant for two hundred and fifty-
dollars and had got his pay in mules cows
and calves. Casey also stated that he sow
defendant deliver to plnintiff a mule some
nws and calves valued at two hundred and
titty dollars in payment fersaid horse. Some
evidence was introduced to impeach and sus-
tain the credibility of the witness. John Able
and it was agreed that the cole object of the
ftntemenu ef facts was to test the legality ot
the decision in ruling out the interrogatories
-and answer.
The ground of objection to the iatcrroja-
tories is. that it constitutes a legal question
and that it was therefore properly overruled.
This grosnd cannot be maintained. A lead-
ing qaesvien is one which may be answered
in the affirmative -er negative and suggests
he desired answer it roust indicate to the
witness in matter material to the issue sach

He had testified to the fact of the sale f the
torse and if the defendant had made any
-admissions it rela'iou to his indebtedness the
plaintiff had the right to prove such ndrois-
ions and the linie at wisxh they were made
and it is djffirult to perceive how the jues-
aon could have assumed a more general form
or one less suggesuic ot a particular ans-
wer. The ruKn j or the Court was therefore er-
roneous and the judgment must be reversed
unless the testimony excluded was merely cu-
mulative and could not have changed the re-
sult. It would under the evidence in this
case be assuming too ranch to decide that the
evidence' could have had no effect on the minds
ot the jury. The evidence whs contradictory.
Two of the witnesses proved that the horse
bad been paid lor and two that two hundred
and fitly dollars was due at or about the com-
mencement of the suit. The evidence of one
of the witnesses proving indebtedness was
excluded and this might have operated pre-
judicially to the plaintiff and secured the ver-
dict to the defendant. We ore of opinion
therefore that the judgment should be re-
versed and the cause remanded for a new trial.

The appellant was indicted tried and found

partial; and went into the trail of the cause
With the pre-determincd purpose to find
tninst the defendant." In support ofthe ap-
plication the defendant made his affidavit in
ututance that he hearJ the juror nay alter
a trial in which he at as juror that il he was
an the jury he would find against the next
wan who employed a certain attorney ofthe
court being the attorney for the deiendant
Reveral witnesses were examined and testi-
fied to the same or similar expression.
Boose of the witnesses understood the juror
tubem earnest and others in jest. The
conversation to which the defendant'aafRdavit
referred was before the trial of this case.
The court overruled the motion for a new
trial and gave judgment upon the verdict and
die defendant appealed. r
The only 'queetfan which require notice
is whether the alleged partiality ofthe juror
entitled tbe defendant to a new trial. And
it it very dear that it did not. The objection
to the juror was known to defendant before
the trial and it is well settled that when a

assault committed by the defendant by
throwing a brickbat .with great violance at
the head of the party assaulted who was
quietly sealed within striking dii-tance and
upon an apparently slight provocation hy
words only. The matter ofsuprise is that the
Jury did not conrcivc it their duty to indicate
the authority of the iolatcd law imposing n
more exemplary punishmen. The defendant
surely had no cause of complaint and we arc
of opinion thai the judgment he affirmed.
