Court rules water lawsuit can proceed
Monday, Jan. 27, the US.
Supreme Court ordered
that Texas’ complaint
against New Mexico be
filed, ruling that Texas
can proceed with its law-
suit against New Mexico.
Texas initiated its orig-
inal action against New
Mexico in 2013, alleging
that New Mexico has vi-
olated and continues to
violate the Rio Grande
Compact, an interstate
water contract between
Texas, New Mexico and
Colorado, by allowing il-
legal and unauthorized
diversions and use, in
New Mexico, of water ap-
portioned to Texas. Tex-
as asks that New Mexico
be ordered to stop these
illegal diversions and to
compensate Texas for
damages it has incurred,
because of New Mexico’s
unlawful activities.
By taking the case, the
Supreme Court confirms
that Texas has estab-
lished that its case has
merit and that it raises
important and serious
issues that should be ad-
dressed by the Supreme
Court. The order allows
New Mexico to file a mo-
tion to dismiss the action,
which is a procedural
right that is normally
afforded parties in litiga-
tion.
“I am pleased that the
Supreme Court has
accepted Texas’ case
against New Mexico.
This is an important step
in our case. We are pre-
pared to move the law-
suit forward,” said Pat
Gordon, the Texas Rio
Grande Compact Com-
missioner.
“The Supreme Court’s
acceptance of the lawsuit
is an acknowledgement
that Texas has met its
burden that the case has
merit, and that it should
be handled by the Court,”
said Texas Commission
on Environmental Qual-
ity Chairman Bryan W.
Shaw, Ph.D., RE. “We
believe that New Mexico
is in essence withholding
water that is due Texas
under the Rio Grande
Compact, and that the
Compact must be up-
held.”
“We are grateful that
the Supreme Court has
taken this important
action,” said Texas Wa-
ter Development Board
Chairman Carlos Rubin-
stein. “The Rio Grande is
an important part of the
water supply for Texas’
Border Regions, and this
water should be available
for use.”

AARP Foundation
Tax-Aide, in its 45th
year, is the nation’s
largest free tax assis-
tance and preparation
service, providing free
tax assistance to Tex-
ans of any age and giv-
ing special attention
those 60 and older.
You do not need to be
a member of AARP or a
retiree to use this free
service.
“Every year, thou-
sands of Texans help
their neighbors navi-
gate filing their income
taxes, which is admit-
tedly one of the most
complicated processes
we have to go through
each year as Ameri-
cans,” said Ron Craig,
the volunteer leader
who coordinates AARP
Foundation Tax-Aide
throughout the state.
“We’re excited to offer
this service yet again
in 2014 for free; it’s
about neighbors help-

The Buzbee’s followed
the car until they ar-
rived at an intersection.
Patti Buzbee was still on
the phone. The car had
stopped to changed driv-
ers.
According to Buzbee,
the white man came out
of the passenger side
rear window and pointed
a long gun at them. The
couple drove their truck
into the ditch out of his
potential line of fire.
“We didn’t pressure
them anymore the re-
mainder of the way into
Queen City,” he said.
The suspects were
caught at the intersection
of FM 2791 and Hwy 59
in Queen City. DPS and
the Queen City Police De-
partment assisted Cass
County Sheriff Deputies
with the stop. According
to Sheriff Rowe, his depu-
ties could not make an ar-
rest for lack of evidence
since the suspects had not
actually stolen anything
or committed a crime be-
fore they were followed
by the Buzbee’s.
“We just haven’t got
nothing on them,” Sher-
iff Rowe told the Journal.
