District Court it shall bo the duty of-tho Attorney-General
or in caso ho be not present of the
District Attorney to file a motion for th6 for-
feiture of said bond whereupon said court kliall
proceed without other citation ornotice to declare
said bond absolutely forfeited and tc render
judgement against said company aud sureties for
the amount of said bond upon which judgment
execution shall issuo as in ordinary cases ; pro-
vided thatitsballbe necessary for the Attornoy-
General or District-Attorney to file with said
motion & certified copy cf said bond under the
hand and seal of iho Treasurer and also a copy
of tho contract deposited in the General Land
Office and a certificate of the Commissioner that
said surveys and map or maps ot the land applied
for have not been returned.
Sea G. That any Railroad company having
completed and put in running order a section of
iwenty-uvo mues or more vi its ruaa; may give
notice'of the Bamo to the Governor whose du ty it
shall be to appoint ome ekillfui engineer if there
be no Stato engineer to examine said section of
road and u upon tne report ot saiu engineer
under oath it shall ncrtear that said road has been
constructed in accordance with the provisions of
its cbarter.and or tee general jaws of too btate
in force at the timo regulating railroads thereupon
it shall be the duty of tho Commissioner of the
General Land Office to issuo to said company
patents for tho odd sections surveyed iu pursuance
of the second and third sections of this act; but
in care said lands or s-ay part thereof shall not
havo been surveyed at the time said section is
completed then. It shall bo tho duty of said
Comatiseioner to issue to said company certifi-
cates of 610 acres each equal to sixteen sections
per mOo of road so completed whereupon said
coBspatiy may apply to the District Surveyor of
any land district in this State to survey any
quantity' of vacant land subject to locatinu and
entry lu such district not to exceed twico the
auaatity cf certificates so issued which surveys
shall be made numbered and cdored as directed
in the third section of this act and upon the
return of the field-notes andiusp or maps of such
surveys to the General Land office and the certifi-
cates to issued it thai! bo the duty of the Com-
missioner to issue to said company patents for the
oddsecHpns of surveys; provided that incase
thesarreys arc not applied for before completion
or any section of road H shall not be neceesarv
to depotlte with the Treasurer a bond as required
in the second section of this act
SEC. 7. That fractional sections containing
more than 330 acres shall be regarded as -whole
sect iocs; sad two fractional sections each con-
taining lets than 320 acres shall bo taken as a
whole section under tho provisions of this act;
and all the alternate or even sections shall be re-
served to theuse of tho State until appropriated
by.law.
ISec S. That surveys under the provisions of
tout act may ce maae oy persons employed by tue

with the Coaimistleuer of tho General Land
Office wUhout being recorded iu thb office of the
District Barveyori provided that tha State in no

Sec 12. That the prorwoiu of thu actsnall
not extend to any companj Teceiric from the

company sow entitled by law to receive a grant
of eight sections of Iacd per mile for the con-
struction of any railroaa accepting the provisions
of thia act shall not bo entitled to receive any
grant of land for any branch road; provided this
net shall not be to construed as to give to any
company nor? entitled bylaw to receire eight
sections of land more than eight additional

atleast twenty-fire mile of (be road contemplated
by their charter within trm years after the pas-
sage of this act; end such donation! shall be dis-
continued in every case where the company or
companies shall not construct and complete at
least twenty-five miles of tha road contemplated
by their barter each year after the construc-
tion of said first mentioned twenty-five miles of
road; and further provided that the proviso
herein contained shall not extend to any railroad
the terminus of which is not fixed on the Gulf
coast the Bays thereof or on Buffalo Bayou and
that nothing fn this section shall be so construed
an to extend the durationof any existing charter;
and further provided that the certificates for
land issued undet the provisions oi this act shall
not be located upon any land surveyed or titled
previous to the passage of this act; and further
provided that this act shall continue in force for
the term of ten years from the time it shall take
effect and no longer.
Sec. 13. That no railroad hereafter to be built
shall be entitled to receive the additional sections
of land herein granted unless the railings of such
road shall weigh at least fifty-four pounds to tho
yard.

pre-emption upon the payment into the Treasury of the
ezpensss of surveying which Is hereby fixed at ten cents

tion shall have the exclusive privilege of locating and be
restricted to the location of section lots number three and
for that purpose may dlrlds such certificate and make It
applicable to different lots so as to embrace the aggregate
quantity of land authorized to be located. by it bat no
division of any lot shall be allowed in sucn location except
in those cases where there may ne a iracuonai oaianee con-

lance may be located on the south side of any other section
lot number three but In which case the balance of said
lot number Uiree shall bs reserved and exempted from sale

any free white person over twenty-one years of age who
shall have nald the surveying fees of ten csnts per acre
may enter upon and occupy any section lots number four

the same for three years consecutively snaa ue enuueu to

five cents per acre; and such pre-emption settlers shall

Sec. 4. Be UitrUier enacted. That there shall be and is
hereby established an Internal Improvement System by -the
Stale. As a part of said system the construction of rjie
following railways Is henby authorixed U: A railway
rommenelnir at the city of (lalfoitfln. crossing West Bay
and thence to the county cf Harris and to some point eli-
gible for a railway centre on or near the navigabla waters
of Buffalo Dayou; thence diverging from said central point

corthward. crossing Urn Trinity river and thence not th-
ward to near the XCeches ; there to be branched In two direc-
tions the one running in as direct a ine as possible to the
east line of the State near the northeast corner of Cass
county the other branch to run In as direct a line as pos-
sible to Bed River in Lamar county another trunk or
branch.commenc!ng at said railway centre and running
between the said Braxos and Trinity rivers In a northwest
wardly direction to Preston In Grayson county another
branch or trunk running weitwardly from said railway
centre crossing the Bratos river and branching near the
Colorado and running with -one branch on the east side of
tne Colorado u we ciiy or ausuu ana witn tne ouier urar.cn
to the cltr of Tan Antonio also another road to be com
menced at Fowdernorn on Matagorda Bay and intersect
Ing the branch running to Ban Antonio at or near the city
nf Gonzales. The construction of said railways shall be
commenced at said railway centre In Harris county and at
Powderhorn; and shall be prosecuted cotemporaneously
and for equal distances aanualiy until th; cities of Austin
and San Antonio are respectively reached; after which the
other roads shall continue to be prosecuted to completion
by equal distances yearly until the road between the Trini-
ty and Brazos reaches as high as Preston In Grayson coun

reach Red River In Lamar oonnty and the east line of the
State at or near the northeast comer of Cass county.
Provided nevertheless that the section of railway between
Qllveston ana Houston may at any time us cousiructcu
with either a single or double track n case the Legislature
shall deem It necessary for the Interests of the Etate.
Sec. B. BeM further enacted. That the Internal Improve-
ment Board created by the next section of this act shall
fcurrnnver to nurchase In the road owned by the Buffalo
Bayou Brazos and Colorado Railway Company; and also
the road owned by the Galveston and Red River Railway
Company so far as the wort on said railways is completed ;
but no greater or higher price shall be paid for the said
roads or either nf them than the actual cash value for an
equal amount of construction with ten per cent added to
such price ; and no purchase of either of said roads shall
be made so as to become operative without the assent and
raUfieatlon of two-thirds of the Internal Improvement
Board.
Ehl G. Be it furVier enacted. That the office of Internal
Improvement Commissioner Is hereby created and that It
shall be the duty of the Governor to appoint three Internal
Improrenent Commissioners who shall hare personal
charge and superintendence of all Internal Improvements
constructed or owned by the State but subject to the direc-
tion of the Internal Improvement Board ; which Board shall
be composed of the Governor of the State said Commis-
sioners the State Engineer and Surveyor Secretary of State
Comptroller of Public Accounts State Treasurer Lieutenant
Governor and Attorney General. Said Commissioners shaU
immediately enter on the duties of their office on giving
their official bond and taking the official oath ; and their ap-
pointment shall be subject to ratification cr rejection by the
Senate at Its earliest meeting after snch appointment
provided also said Commissioners shall at any time be sub-
ject to be superseded by a new appointment by the Gover-
nor subject to a like ratification or rejection by the Senate.
Eec. 7. Be it further enacted That the salsries of the
State Engineer and Surveyor and Internal Improvement
Commissioners are respectively fixed at two thousand and
five hundred dollars per year and In that proportion for
any part of a year. It is also provided that they shall
respectively give a bond for the faithful performance of
their duties in the penalty of twenty thousand dollars with
good and aSnple security to be approved by the Comptroller
of Public Accounts and the Governor of the State; and
before entering on the duties of their oluee shall respect-
ively take their official oath for the faithfi 1 discharge of
their dnties which oath may be taken before the Secretary
of State and shall be filed in his office.
Sic. 8. i&flurtJlere-MrclW.That the Commissioners of
the Internal Improvement Fund shall have power to ap-
point all oecemry subordinate officers and assistants to
carry out the objects expressed in sections one and two of

.officers end assistants and to remove the same and ap-
point others at pleasure; and it Is further provided that the
Interna! Improvement Board shall have the'Ilke power to
appoint all necessary subordinate officers and assistants In
In the construction of Internal Improvements and In estab
lishing a superintending police over the same; and to fix

others at pleasure.
Sea 9. Be it further enacted Th&t no contract shall be
entered Into for the construction of any of said railway?
until the sections shall have been surveyed and the work
and Its valne estimated by the Stale Engineer and Sarveyor
and submitted to the Internal Improvement Board; after
which ir a majority pt the Board concur in such estimate
5 per cent shall be added to such estimate and the work

time limited during which the same shall be received. No
bid shall be received or contract awarded on the same that
shall exceed the said estimate and 5 per cent added ; and
the contract shall be awarded to the lowest bidder who
shall give good and ample security for the performance of

proved by said Internal Improvement Board. Provided
nevertheless that in case the contractor shall neglect or
refuse to give security to the satisfaction of the Board the
contract may be awarded to the next lowest bidder who

the Commtaloners from purchasing railway Iron chairs
sntkes. locomotives and fre'ght cars and other secessarv
materials to be purchased out of the State; but which may

be paid as his work advances beyond four-fifths of Its esti

ments out of said fund to be published quarterly with

and regulations by and under which Individuals or Joint
stock companies shall be allowed to equip and run all Tall-

or other svjdences of debt or cash on hand not otherwise
appropriated and seventy -five millions of acres of Land

lmprorements.and the Stale Engineer-acting together or a
majority of .each set of Commissioners) from that portion of

the sale of said land and all tand not bringing: such mini-
mum price shall remain open for location or pre-emption
until otherwise disposed of.

Sec 6. That the nett proceeds of so mush of the Public
Domain as Is hereby set apart for School Fund and all
other means hereby made a part of said School Fund after
paying the salary of officers and other Incidental expenses
shall be Invested In railroad iron and said iron rented to
the proprietors of the three main trunk roads in equal
quantities each annually provided always that the rail-
road companies or their agents shall require said Iron and
are prepared to fqlflll the conditions and requirements
hereinafter specified and whlojj may be required by the
Commissioners of the School Fund to sjcui.e the payment
of the rent and absolute control or the h-BP When either
of the companies belonging to one of the three great main
trunks shall have completed 35 miles of voad ready to
receive the iron the State shall loan and deliver at the
Wharf on leaboard where the State officers may receive It
as much iron as will supply 25 miles and from time to time
thereafter a ship load as they may require it as aear as
practicable for the State to do. And the Company to whom
the Iron shall ba loaned shall g've their obligation to take
and put this Iron down on a certain road In a workman like
manner and forthe use and rent thereof shall pay to the
Treasury of this State the sum of ii pf r pent per annum
payable quarterly 00 the cost of the frop whwe the State
receives it and loans It some msrnbsr of the State Board
shall make this contract and transact the business agreea-
ble to on crder of said Board made in Joint session and In
said bargain they shall bind themselves to pay In addition
an annual increase of one per cent per annum after the
first ten years until the original price of the iron shall have
been paid for over and abort the six per cent per annum
the Company always having the privilege or buying the
iron at any time by giving six months notice The three
trunk roads shall begin and end as follows: Eastern be-
ginning at some point on the navigable waters connected
with the coast or the Eastern District best calculated to
accommodate said District and running thence northward
by the most practicable route till It shall have reached SS
SO' north latitude unless It sliall Intersect the main Pacific
road or route leading from California short or said latitude.
Middle beginning at some point on the navigable waters or
Galveston bay at ornear Galveston city and running thence
north-westerly by the most practicable route till It shall
reach S30 80 north latitude unless it shall Intersect the
main Pacific road or route Ieadingfrom California short of
said latitude. Western beginning ataome navigable point oa
Matagorda Bay and running thence to San Antonio thence
north-westerly by the most practicable route till It shall
reach 83 80 -north latitude unless it shall Intersect the
main road or route leading from California short of the
latitude aforesaid.
Sec. T. That no railroad Company that shall receire a
loan of iron shall ba entitled to more thanslxteen sections
of land per mile as a donation and every one of the three
main trunk roads provided for in tills act my send off one
lateral or branch road any where between fifty and one
hundred and fifty miles from the coast or any two roads
may be carried forward from the aforesaid distance from
the coast to suit the convenience of that particular District
which shall be entitled to a land donation or sixteen sec
tlonjtothe mile length not to exceed 100 miles ; and all
that portion of the Pacific. Railroad when actually built on
and across the northern part cf tills State between the S2
and 83 degrees or north latitude shall also be entitled to
sixteen sections of land per mile and no other railroad sliall
reclre any donation ot land or rent Iron or borrow money
of the State until tha three trunks aforesaid are completed
and no one of the three Districts into which this State Is
divided shall receire any more encouragement from the
State than another either tn land Iron or money for In-
ternal Improvements; and further that no railroad here-
tofore chartered by this State which has not fulfilled tlie
entire conditions of Its charter shall receive any State aid
in land money or iron unless they shall form one part of
the three great lines first provided for ; and all laws to the
contrary are hereby repealed.
Sec S. TLat whenever any Company renting iron from
the State Board shall neglect or refuse to pay the rent of
said iron every ninety day. the State Board shall order the
State Engineer to take possession of the Rood of such Com-
pany or Its rents and books and all the running stock and
other things pertaining to the delinquent Company's road
until the said Engineer shall have rectlved nett proceeds
over reparlrs and running expenses sufficient to make up
the deficit or the last quarter year and said Board shall
never rent iron to any Company without reserving tlie right
above mentioned to secure the collection of the quarterly
rent and also to go on to the road and take up the Iron at
the expense of said Company who fait neglect refuse or
apparently become unable to fulfill their contract for the
term of six consecutive months and the Company shall be
bound In said contract to continue and punctually psy the
said Interest of six per cent per annum and after ten years
an Increase of one per cenC per annum lncreaslngyearly
one per cent till It shall have equalled In the aggregate the
original price of the iron unless said Company shall pur-
chase said Iron before
Set. 9. That the Commlsiloners of the School Fund and
the Commissioners of Internal Improvements mentioned
and described In sections 1 and 2 when acting In Joint
session shall be styled the State Board or Education and
Internal Improvements.
See. 10. That said State Board of Education and Internal
Improvements shall meet once or oftener In each year
and determine on tfae rules and regulations necessary to be
adopted for tho government and management of these great
interests to the best advantage to the State consistent
with existing laws ; and whtn a majority or each or the two
sets or Commissioners shall be in Joint session the shall
agree upon the locality and quantity of land to be surveyed
and brought Into market during Die succeeding year and
the amount to be invested and the manner of snch invest
ment and the particular Improvements to be encouraged
and to what extent.
Sec 11. That said State Board shall make on accurate
detailed report to .very Legislature within thirty days
after the commencement of each session thereof and an
reports of this kind shall make the first day of September
the beginning and end or each fiscal year. There shall be
an annual meeting ot said Board for these purposes on the
first dsyof September in each year and all the detailed and
separate reports necessary to be embodied In the general
renort to be submitted to the Lesrlslature. shall be rendered
to the Comptroller whose duty It shall be to report to the
Legislature
Eec 12. That it shall be the duty of the Commissioners of
the School Fund to manage to tlie best advantage all
things belonging to that fund; to recommend from time to
time tn the Legislature the adoption of such measures as
may be tnonjbt proper by them for the Improvement of the
fund and to report to the Legislature at the commencement
of each session thereof the state of said fund.
Sec 13. That the annual report required of the State
Board of Education and Internal Improvements shall ex-
hibit a. statement of the funds entrusted to tbeircare apd
management from the first day of September In each year
to tbeSlst day of August in each subsequent year inclusive;
and the amoustt of said funds In the Comptroller's offict.

Sec 14. That each of the State officers whose duties have
been hereby Increased shall have the power to appoint or
employ thenecessary number cf clerks to assist in discharg-
ing the aforesatdjnereased duties and draw sn the School
Fund for the payment thereof.
Sec 13. That the fostrd of School Fund Commissioners
shall regulate the amount f such compensation.
Sec 1C That the Treasurer shall receive rad safely keep
tllaonev. stocks bonds and securities' and other evidences
of debt that ore hereby made or may hereafter become a
Plrt at the School Fund subject always to tha order of the
Beard of the School Fund Commissioners.

Sec 1. That the Board of School Fund Commissioners
shall annually choose one of their number to be their
President and another from time to time as their Secretary
who shall keep and preserve regular mjnntes or all their
proceedings.

ternal Improvement Commissioners shall receive the sum
or Two Hundred Thousand Dollars from the School Fund
and divide and appropriate the same to the Improvement of
such Rivers as In the opinion of said Board would enable
the State to collect a toll on pertom properly and boat
transported on the river so Improved equal to sir per cent-
Interest on thearoougt so Invested aftss defraying expense
or collodion : Brovlded always that one-fourth of all the
money proposed to be expended on any one Improvement
shall be raised by voluntary subscription by the parties Im-
mediately Interested In said Improvements and that said
subscription money be plseed In the Treasury whereupon
three times that amount shall be appropriated from the
School Fund and expended on said Improvement under the
direction of the Internal Improvement Board. All said
appropriations shall be confined to the rivers hereinafter
specified and the total sum so appropriated shall not ex-
ceed the sum of Two Hundred Thousanl Dollars. The said
State Board shall make all needful regulations forthe col-
lection ot the M oa said Improvement to pay the interest
on all sums taken from ttte Stih0l Fmid and. expended on
And further That all lands being within two chains of the
shore of such Improvements shall be subject to the same laws
as to the occupation or the land or use of materal thereon
are concerned as ir the water or river was a highway or a
public rosd. .
Sec. 24. That each and every officer contemplated In
any or all the sections of this Act shall before entering on
the duties of his office take and subscribe an oath which
shall be filed wf th. tl Governor that he will faithfully and
honestly discharge the duties or his office and conduct all
matters pertaining thereto to the best or his ability and the
Interest or this fund and the State at large. The violation
of said oath shall be punished by har.l labor In the Peniten-
tiary forthe termor not less than one year nor more than
three years.
The salary of the Commissioner of the Internal Improve-
ment Board shall be each payable
monthly. The salary of the State Engineer shall be

Stcrioxl. Be it enacted by the Zegltlatnre of Vie State
of Texas That the Comptroller Attorney General and Com-
missioner or the General Land Office shall ex-officio con-
stitute a Board of School Commissioners whose duty It shall
be with the approbation of the Governor to draw from the
Treasury the special school fund created by the act of Ja-
nuary 81st ISM entitled An Act to establish a system of
schools and Invest the same as provided in this net. And
said Board shall annually report to the Governor Its acts
and proceedings relative to said school fund.
Sic. 3. That the five per cent Indemnity bonds belonging
to said special school Junfl may and sjjall be loaned to
legally Incorporated railroad companies In thfs State at their
current value provided sad valne shall not be less than
par otherwise at par for the term of ten years from the
date of raid loans at an interest pf six per cent per annum
payable annually upon the terms apd conditions specified
In this act.
Sic. 3. Said Board of Commissioners Is hereby authorized
with the approbation of the Governor to Invest said funds
by loaning to any such company which has been or shall be
hereafter chartered ror the purpose or building a railroad
In this State the sum or six thousand dollars per mile ror
each and every mile or railroad constructed as hereinafter
provided. Said loans to be secured by the bonds of such
company for said principal and interest made and execut-
ed to the State ot Texas in the corporate name or such Com-
pany signed by the President and countersigned by the
Secretary or Treasurer under the seal or such company;
which bonds shall constitute 3 lien upon the road and char-
ter rights of such company Including the road-bed right of
way jfradipggjridges; iron rails. equipments and masonry
and upon all the stock subscribed for in said companies all
the depots and depot stations and all the property owned
by such company as necessary for its business. And the
State of Texas upon the execution of said Bonds and by
virtue of the same shall be Invested with said Hen or mort-
gage ror the payment or said bonds and the interest there-
on as the same becomes due without the necessity or any
deed special contract or act or registration.
Sec. 4. Said Board or Commissioners shall with the ap-
probation or the Governor loan said sum or six thousand
dollars per mile to any such company as shall have com-
pleted In a good and substantial manner and furnish ready
Tor actual use a contlnuons section at twenty-five miles at
either terminus of the road or said company; and the same
amount per mile for every additional consecutive section of
ten miles which shall be sn completed on the trunk or any
established branch of the said road. And the same amount
per mile for every sectUn of ten miles which shall be so
completed and furnished ready for use upon any railroad
which shall be a continuation of or connection with any
other railroad running from any adjoining State or Terri-
tory Into the State or Texas provided said road shall
together with such continuation or connection be com-
pleted at least twenty-five miles In length..
Sec. 5. That upon the application or any such railroad
company to said Board or Commissioners for said loan and
Its representation that section 4th of this act has been com-
plied with said Board of Commissioners shall with the ap-
probation of tlie Governpr appoint some competent En-
gineer who shall at the expense of the company examine
the road of said company and make a full report upon the
condition of the some under oath and shall report all mat-
ters pertaining to the business or said company which he
may deem useful to said Commissioners in ascertaining the
true condition of said road and company. And upon being
fully satisfied that any section or sections or said road have
been constructed and completed as provided in the 4th
section or this Act and that said section or sections are not
subject to any lien whatever other than such as may be
created by this act in favor of tlie State said Board shall
with the approbation of the Governor draw a warrant on
theTreaspryof the State In the name or said company
against said special school fund for such amount or said
bonds as it may be entitled to under the provisions of this
act which warrant shall stte on account of what work it
Is drawn shall be signed by said Board Of Commissioners
and countersigned by the Governor and delivered to the
President or the duly authorized agent of said company.
Eec C. That upon the presentation of said warrant or
warrants to the Treasury of the State the amount of said
indemnity bonds called for in the same shall be delivered
and transferred according to law to the President or au-
thorized agent of said company his receipt taken therefor
and the same charged to the special school fund.
Sec T. That before said Board shall deliver to said com-
pany said warrant or warrants upon the Treasury it shall
require said company to execute and deliver into the Trea-
sury the bonds of said company for said loan or loans In
sums of not more than one hundred and fifty thousand
dollars and not less than fifty thousand dollars each pay-
able to the State of Texas ten years stter date together with
coupon bonds tor the six per cent Interest therson payable
annually as above stated; which bonds sliall be executed
In the mode prescribed in the third section or this act and
shall be made payable at the office or the Treasurer or the
State and which skall be a Hen in ravor of the State as
specified In tho 4th sectioi of this act and sliall have a
priority over all other claims against said company.
Eec 8. And after the execution of said bonds upon said
first section or any subsequent constructed section It shall
not be lawful for said company to give create or convey to
any person or persons.or body corporate whatever any lien
incumbrance or mortgage of any kind which shall have
priority ever or come in conflict with the Hen herein secur-
ed and any such lien Incumbrance or mortgage shall be
null and void as against said lien or mortgage in favor of
the State.
Sic 9. That it shall be the duty of any such company as
the interest becomes due upon sa'd bonds executed as
aforesaid to deposit the same In the Treasury of the Stale
which amount shall be credited to the special school fund
and shall be subject to immediate appropriation for school
parposes as provided by law. And all railroad companies
shall pay said Interest so due by them annually.on the first
day of March and the bonds of such companies so satisfied
shall be cancelled and delivered up.
Sec. 10. Whenever any of the bonds of said company for
the principal loaned inereon sqaii ira ""i '" "?
ny shall deposit said sums so due. In the Treasury of the
State and said bonds shall be canceUed as required in sec-
tion 9th of this act and said principal sums so returned
Into the Treasury shall be credited to the special school
fund and subject to re-Investment by said Board as pro-

Sec 11. That If any such company shall fall or refuse to
oar said principal or Interest bonds from time to time as
the same shallbecome doe the road of said I csapany
together with all the rfgbts and property of said company
specified In section 8d of this 1 aet shall be sold or cau.ed to
bVsold by the Governor or the State for the satisfaction of
said bonds so due as well as all the bonds or said company
which may have been given under this act to the State;
and the whole ot said bonds shall be deemed due ir said sale
takes place and the proceeds or such soles shall be deposit-
ed In the Treasury and credited to the special school fond.

State and at the time spedfled In said advertirement ; pro-
vided that If the principal or Interest bonds which may
have become due before the giving or said notice and all
costs attending said proceedings shall be paid before the
day of sale then said proceedings for sale shalt be stopped.
Sec 13. In the event r any sale or any railroad underjine
necessary to protect said Interest; buy In said road with all
the rtrbti and property belonging to said company In the
nameTr the State? provided he shaB not bid more than the
aroTunt of the bonds of said compear with the Interest due
thereon and the costs and expenses attending said sale
And In t ic event or any such purchase to the name or the
State the Governor shall appoint Receiver who shaUbe
reoulred to enter into such bonds as may be required by the
Governor and whose duty It shaH be to control and manage
taid road nnder direction or the Governor acta otherwise
disposed of by law.
