Until now it has been difficult to
keep on top of hot check cases,
County Attorney Maida Modgling
told Commissioners Court recently
as she outlined plans to update the
system being used in the county.
A new computer and a new em-
ployee are the fuel which will be
warming things up for hot check
writers in Medina County, she said.
Since January, more than 2,400
letters have been sent to hot check
writers, well over 100 cases have
been filed, and restitution amounting
to more than $6,733 has been col-
lected, along with more than $54,345
in fines and court costs.
Writing hot checks is breaking the
law, but for some it is a common
practice, Modgling told those who
attended a hot check seminar Friday
in Hondo. She plans to hold other
seminars in the county to educate
business owners and individuals on
how to collect hot checks.
Modgling outlined check collec-
tion procedures. First the merchant
must send a registered letter to the
check writer demanding payment
within 10 days. If no payment has
been made, the check and a copy of
the letter should be brought to the
county attorney's office and a com-

Modgling's office giving the check
writer one more opportunity to pay
up. A hot check fee of 10% is added
to the value of the check.
If the letter is not answered, a
criminal case is filed, based on the
complaint, and court costs of ap-
proximately $159 are added. Once
such a case is filed, the court costs
must be paid even if the case is settled
out of court.
A first conviction could receive a
waived fine, if the check and court
costs are paid. A second offense will
be assessed a $100 fine in additon to
the amount owed and a jail term
could be given. A one year jail term
can be assessed, along with monetary
damages, for a third offense.

in accident Sunday

Daniel P. Blankenship, 37, a resi-
dent of the Biry area, was killed in a
one-car accident about 7 p.m. Sunday
on Highway 90 a mile east of Dunlay.
Injured in the accident was Brian P.
Farrell, 28, of Sunrise, Florida. Far-
rell was listed in critical condition late
Monday at Medical Center Hospital
in San Antonio.
Blankenship, who as a master ser-
geant conducted an instructors train-
ing class for the 3250th Training
Wing at Lackland AFB, was pro-
nounced dead at the scene after the
1987 Ford Bronco he was driving
went out of control and rolled several
times along the median on Highway
90.
According to a Texas Department
of Public Safety spokeswoman, the
two were westbound when the

Bronco, driven by Blankenship, went
out of control.
The investigating tropper report
said, "The vehicle was traveling west
at a high rate of speed when it ran off
the road to the left, came back on the
roadway, swerved back to the left
going onto the median. There it rolled
numerous times, then went into the
east bound lanes and came to rest on
its top facing the direction from
which it had come."
Both the driver and passenger were
wearing seat belts which would have
helped had they not been going at
such a high rate of speed, the DPS
spokeswoman said.

Harold Herring of Hondo pro-
nounced Blankenship dead at 8 p.m.

ket Trail Day, on Sat., July 14,
Hondoans can participate in the
First Ever Splash Fest
Four-member teams will com-
pete in five events, including a wa-
ter balloon toss, a wheelbarrow
race, a water relay, watermelon
seed spitting and tug-of-war.
Participating teams are invited to
enter and challenge other teams in
competition. Trophies and ribbons
will go to the top six teams.
Entry fee is $20 for each four
member team, with proceeds going
to the Medina County Association
for Exceptional Children.
All ages may compete.
