AN OFFICE SEEKER
Washington September 20 Special
Here is an Interesting story which has
Just leaked out and It Illustrates that the
office seeker can never be sure ot bis Job
unjll be has been sworn lu
Shortly after the November election ot
last year Captain Edward T Semans a
prominent Now York republican thought
ho would like lo have something good un-
der the Incoming administration After
looking tbo field over ho concluded that
tbo office editor ot tbo laws state de-
partment would suit him It paid a sal-
ary of 3000 per annum Tho editor is his
own bees he comes and goes at will
Tbo only time ho is realty busy Is during
the wind up of a session of congress This
oftico the captain wanted so bo set out to
secure indorsements And ho was success
ful IIo was Indorsed for tho position by
the New York legislature the supremo
court ot the State the county officers of
Ontario county tno district judgo and
others Tno captains friend thought bu
had a cinch and that when tho new admin-
istration was installed all he would have
to do would bo to prcicnft his application
and get tho appointment
March 8 ho called nt tho state depart-
ment and saw Secretary Sherman with
whom ho had an Interview The secretary
seemed somewhat surprised to learn that
there was such an office lu his department
If there was such an office It was under
civil service Captain Semano assured the
secretary that thooffice was there and fbat
Harry Olirlen a democrat was holding it
und that tho office was not under the civil
service
Woll saltl tho secretary get mo some
additional Information on the subject I
am not qulto satisfied
In a fow days tho captain returned to tho
department nnd had another interview with
tho secretary Ho urged that ho bo ap-
pointed to tho office oil he was tho only
applicant Tho secretary put him off with
an excuse nnd told him to como back on
Friday Tho captain did so Ho did not
sco tho secretory but be saw the chief
clerk who informed him that tho secre-
tary had Just appointed his soninlaw Mr
James I McCallmu
Of course tho captain was sore Any cna
would bo under similar circumstances
After thinking of tho treatment ho had te
celycd nnd tcflectlnj that the civil service
commission had deceived him about tho
office ho determined to lay the matter be-
fore the president Accordingly ho wroto
tho following spicy lottor to the prsoldent
Who as Is usual In such cases acknowl-
edged Its receipt stating that ho had re-
ferred tho letter to tho civil service com-
mission for reply which up to date Sap
tain Somalia ha not received
Hon William McKlnley President ot
tho United States Washington
n o
Washington April 20 Sir I havo
the honor to address you tWs communi-
cation for tho purposo of placing be
fore you Homo facts relative to tho of-
ficial conduct ot Hon John It Proc
tor president of tbo board of civil ser-
vice commissioners which It Is be
UOved Is of such a character as to
Justify my action
About January 1 1807 I decided to
mako application for appointment to
tho position knows ns editor of tho
laws department of state
In consulting with friends I was ad-
vised thut according to a report made
to tho congress by tho civil sorvlco
commission In response to a houao
resolution thnt It appeared that this
particular position was regarded as
being within tho purview of the recent
orders of tbo executive extending tho
civil service 1st
I thereupon addressed a nolo to Mr
John T Doylo secretary of tho com-
mission asking whether said position
was or was not within tho classified
sorvlco Mr Doylo declined to answer
my Inquiry In person and referred my
letter to tho Board for reply
Under datolbt January 13 11197 I
received tho following reply towlt
Air E T Somans Attornoyatlaw
Washington D C
Sir In reply to your letter of the
11th Inst you aro Informed that the
position of editor of laws In tho
stnto department s classified A va-
cancy In this position If not fjjled by
reinstatement transfer prom tion or
reduction would be filled ns n result
of n special oxamtnntlon In accord-
ant with tho statements mnde In tho
onclosed circular Very respectfully
John It Proctor President
Upon receipt of tbls lottor I ceased
to push my application until about
Fcbrunry 1 when I wns advised that
In nil probability Bomothlug would ho
doneto nmond or modify the scopo and
effect of tho executive order to which
I have referred Hut It wns then too
lato for mo to secure much valuable
support that I could havo secured ear
lier and when I filed my application
March 15 1S97 my Indorsements wero
not as strong ns I would hnvo mado
them had I been told tho truth by the
elvl scrvlco commission for as sub-
sequent developments proved tho po-
sition was not within tho classified
service never had been and never
could bo
It s proper to stato < hat my nppllca
tlon was the first formal one over filed
for this pnsttlon as I have beon cred
itably Informed nnd upon tho request
of Secretary Sherman I procured tlio
authority of law upon which wis based
the creation ot the said position and
which Is found in section 5 of tho act
pf Juno 20 1S74 and which accord
ing to my Interpretation ot tho statute
in to say tho least a questionable au
thority Tho labor is performed un
der a sporlal contract with the secre
tary of state and Is only legalized by
the appropriation cf tho congress at
tho closo of each si ssn to cay for
the work It is not therefore such
a position as could bo properly re-
garded as being within the au hortv
of the executive to control bv virtue
of tbo nuthortty vested In him by tho
provisions of tho civil service act so
called
1 contend that the action of Mr
Proctor in stating to mo oyer his of
ficial signature that the pwllon was
within the classified sorvlco when if
he knew anything at all about It ho
must havo known that such poslton
was not amenable to classiflcatlin
Under tiny law was such acthn as
might prosrrly b regarded aS Mitflct
ff to disqualify him for thei duties ot
the office ho holds
The other rolnts Involved In this
somewhat remarkahle trmsctou nro
such as would moro propcrl came be
fore the senate committee to investi
gate the civil service and I yin Mt

Tho Dlnelov tariff has been in opera-
tion since Julv 24 nearlv two full months
Its effects aro far from what Mr Dingley
predicted thev would be Hero Is his cs

Tho averaee revenueproducing quali-
ties of the Wilson tariff act are about 150

no doubt that tho new law after the effect

overcome a revenue
excess of 225000000 dot annum Wrat
will be the orobable receipts for the pres-
ent fiscal vcar In view of the largo antici-
patory ImDortatlons It is probablo that
tho treasury has lost by theso importa-
tions at least 40000000 which mmt be
deducted from the 225000000 which this
bill will vlcld That leaves 5165000000
So that this bill Is estimated to yield
185000000 during the current llrcal year
It must be borne tn mind that 32O0OO0U
paid into tha treasury In he la > t four
months reallv belones to tho evenue for
tho Dresent fiscal year Now it Is esti-
mated that tho rovenuo from oil other
sources ordinary internal revoaua tax and
miscellaneous sources outside ot postal
revenue will bo 180000000 or probably
185000000 Theso two estimates clvo us

Tho expenditures of tho government
tlurluc tho last fiscal vear nstdo from
postal account were 365000000 nut there
were some expenditures paid this year that
belonc to tho last year so that tho ex
penditures mav be placed at 37000000 a
year There would then bo enough rove
tue notwithstanding the lens or 10000
000 to meet the expenditures Uut If these

greater th i estimated then thero can be
