ary A. D. 1935, in a suit number-
ed on the docket of said Court
No.-2961, wherein J. H. Parker, is
Plaintiff and Frances Parker, is
Defendant, and said petition al-
leging that on or about March
10th, 1933, plaintiff and defend-
ant were lawfully married in
San Diego, California, and lived
together as man and wife until
the 10th day of April A. D. 1933,
when they finally became separat-
ed; that plaintiff has been a bo-
na fide inhabitant of Jack Coun-
ty, Texas, for more than twelve
months prior to the institution of
this suit; Plaintiff alleges that
the defendant was guilty of com-
plete impotency of body, at the
time of said marriage, that dur-
ing the term of said marriage de-
fendant was guilty of adultery;
that defendant is guilty of excess-
es, cruel treatment and outrages
of such a nature as to render their
living together insupportable.

of C. E. Anderson, charged with
slaying U. E. Byers.
The first defense witness was
Alfred Caldwell, caretaker of
Lake Bridgeport, who testified
that Byers had tol dhim prior to
the shooting that he had slapped
a woman and that she had gone
to Decatur tv swear out a com-

Mrs. Anderton testified that
Byers slapped and abused her
her when she went to his store
to purchase ice. She said she
told Byers that »hc was going to
notify her husband and that By-
ers said: “Tell your husband, 1
am not afraid of him.”
John Everts, former deputy
sheriff at Bridgeport, testified
that Byers’ reputation w-as that
of a “high strung’ ’man.
