S.B. No. 2514
Chapter 875
1 AN ACT
2 relating to the powers of the North Fort Bend Water Authority.
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
4 SECTION 1. Section 8813.007, Special District Local Laws
5 Code, is amended by adding Subsection (c) to read as follows:
6 (c) Chapter 36, Water Code, does not apply to the authority.
7 SECTION 2. Subchapter C, Chapter 8813, Special District
8 Local Laws Code, is amended by adding Section 8813.120 to read as
9 follows:
10 Sec. 8813.120. ACTION AGAINST PERSON, DISTRICT, OR
11 POLITICAL SUBDIVISION. (a) The authority may bring an action in a
12 district court against a person, including a district or other
13 political subdivision located in the authority's territory or
14 included in the authority's groundwater reduction plan, to:
15 (1) recover any fees, rates, charges, assessments,

16 collection expenses, attorney's fees, interest, penalties, or
17 administrative penalties due the authority; or
18 (2) enforce the authority's rules or orders.
19 (b) Governmental immunity from suit or liability of a
20 district or other political subdivision is waived for the purposes
21 of an action under this section.
22 SECTION 3. This Act takes effect immediately if it receives
23 a vote of two-thirds of all the members elected to each house, as
24 provided by Section 39, Article III, Texas Constitution. If this
