CHAPTER 400 H.B. No. 148
1 AN ACT
2 relating to the prohibition of the manufacture, sale, or possession
3 of a counterfeit disabled parking placard; providing penalties.
4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
5 SECTION 1. Chapter 681, Transportation Code, is amended by
6 adding Section 681.0111 to read as follows:
7 Sec. 681.0111. MANUFACTURE, SALE, POSSESSION, OR USE OF
8 COUNTERFEIT PLACARD. (a) A person commits an offense if, without
9 the department's authorization, the person manufactures, sells, or
10 possesses a placard that is deceptively similar to a disabled
11 parking placard.
12 (b) A person commits an offense if the person knowingly
13 parks a vehicle displaying a counterfeit placard in a parking space
14 or area designated specifically for persons with disabilities.
15 (c) An offense under Subsection (a) is a Class A
16 misdemeanor. An offense under Subsection (b) is a Class C
17 misdemeanor.
18 (d) For purposes of this section, a placard is deceptively
19 similar to a disabled parking placard if the placard is not a.
20 genuine disabled parking placard but a reasonable person would
21 presume that it is a genuine disabled parking placard.
22 SECTION 2. The change in law made by this Act applies only
23 to an offense committed on or after the effective date of this Act.
