Wichita, Kan., July 12.—Bored to
what would be the verge of tears were

Las Vegas, N. M., July 12.—District
Judge D. J. Leahy, who is sitting here
in the libel proceedings instituted
against Carl Magee, Albuquerque edi-
tor, showed some of the fighting qual-
ities that led him in the charge up San
Juan Hill in the Cuban campaign years
ago with Theodore Roosevelt when, in
open court yesterday he walked to the
front of the bench and dared the
writer of a letter signed "K. K. K. to
come forward and face him.
A short time before the challenge,
Judge Leahy had received through the
mail a letter calling him "you old Irish
judge,” and declaring if he didn’t like
this country he had better go back to
Ireland. The writer of the missive
said he was attending the Magee trial
and would be in the courtroom yester-
day. The court said that the writer
of the letter was a dirty cowardly
reprobate, but no one acknowledged
authorship.
While this incident was the feature
of the trial yesterday afternoon, two
others served to inject unusual
elements into the case.
R. P. Hanna, former state supreme
court justice who is chief counsel for
Magee, was adjudged guilty of direct
contempt of court by Judge Leahy
shortly after Hanna, questioning a
witness for the defense, had asked
whether Judge Leahy was intoxicated
When, the woman testified, Judge
Leahy was riding- in an automobile
driven by M. M. Padgett and which
was alleged to have struck a resident
of Las Vegas and resulted in his death.
No further action would be taken con-
cerning Hanna, the court said, for the
present.
Mrs. E. S. Comstock, who swore that
Judge Leahy was in the Padgett car at
the time of the accident, was twice
called to task by the court, when she
made that statement. On the occasion
of addressing the witness the second
time Judge Leahy said “the court
knows that this witness lies when she
says I was in the car with Padgett at
the time of the accident.”
