FORTY-THIRD LEGISLATURE-SECOND CALLED SESSION. 75
FUR-BEARING ANIMAL LAW FOR HOUSTON COUNTY.
H. B. No. 65.] CHAPTER 26.
An Act permitting the taking of pelts of fur-bearing animals for the pure
pose of sale in Houston County during the months of December and
January; making it unlawful to take such pelts or to employ a steel trap
for taking any fur-bearing animal during any other months than December
and January; providing a penalty; repealing all laws or parts of
laws in conflict with this Act, and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. It shall be unlawful to take the pelt of any furbearing
animal in Houston County except during the months
of December and January, of any year. During the months of
December and January of any year, it shall be lawful to take
such animals by a trap or any other device, upon one's property,
or upon property upon which a written permit has been
given by the owner for trapping purposes, but at any other
time it shall be unlawful to use a trap or any other mechanical
device for taking any fur-bearing animal in Houston County.
The pelts of any fur-bearing animals taken by the authority
granted in this Act may be sold or offered for sale in conformity
to the laws of this State.
SEC. 2. Any person violating any provision of this Act
shall be deemed guilty of a misdemeanor, and upon conviction
shall be fined in a sum not less than Ten Dollars ($10.00) nor
more than Two Hundred Dollars ($200.00).
SEC. 3. All laws or parts of laws in conflict with this Act
are hereby repealed.
SEC. 4. The fact that the present law applying to Houston
County does not permit the trapping of fur-bearing animals at
any time and results in curtailing the opportunities of the people
of said county to profit from this great natural resource
creates an emergency and an imperative public necessity that
the Constitutional Rule requiring bills to be read on three several
days be suspended and the same is hereby suspended and
this Act shall take effect and be in force from and after its passage,
and it is so enacted.
