employed by the federal government as an investigator for the Department of Labor
and as an agent of the Internal Revenue Service.
When asked about the various mineral interests held under the name of J. W.
T-ner Trustee he declined to answer, stating that:
I cannot discuss a communication made to me by my client
during the existence of the attorney-client relationship.
He was told:
Now Mr. Tyner, I don't want to in any way trespass upon the
privileged communication between attorney and client, but
the Committee has the right to investigate the transaction to
determine whether or not an attorney-client relationship
existedo
He refused to identify his client. He refused to identify the purpose, nature or extent
of the employment. He declined to state whether the interest held by Tyner
Trustee related to legal work done by him for a client.
Attorney General Wilson stated:
I think that in fairness to you I should say that if it
develops that this is an attorney-client relationship,
and a legal transaction that is in effect bribery, I for
one will take it to the State Bar Grievance Committee.
A. That information has already been communicated to
me by some of your employees.
Vice Chairman Hollowell told Tyner that " you are perhaps entitled to claim
this privilege if an attorney-client relationship exists, but if there is no relationship
that privilege did not extend to Tyner. " He was told there is nothing in the attorneyclient
relationship which permits an attorney to violate the law, and if the transaction
is illegal he is outside the scope of the lawyer-client privilege.
He likewise refused to discuss the Tyner Trust interest in. the Earl SharpBramlette
Lease, Earl Sharp-Hammill Lease and the Robert Cargill-Albert
Castleberry Lease.
Tyner was shown a copy of the June 20, 1960, check payable to E. W. Scates,
Trustee, for $1,000.00 bearing the signature of J. W. Tyner. He declined to
identify it.
He declined to identify the check issued for the purchase of the 1961 Chevrolet
registered to L. D. Murphy.
