there had been no fighting there since the Battle of Shiloh, except
two skirmishes which were unimportant in their results, that the
man who gave me the paper said that a Mr. Mahan, a man whom
he knew and I knew, said there had been no important battle there,
and was not likely to be one soon, that he had come directly from
there.
Graham observed that it was a lie that he had the paper of the
loth. I told him that Tom Wilson saw this paper, which was dated
the i2th when it was given to me, that he went to the Office sup-
posing that he had the same paper there, he then returned & said
he had no paper later than the loth. He then took the paper and
sat down in the public room at the "San Antonio House," and
read it, that the important news he read aloud, and that part of
the news was the same as I had stated to him, and that if it was
a lie, he had it as cheap as I had it. He got up and went off in a
huff saying that no man could tell me anything without my con-
tradicting him, and that was all I had with him relating to that.
This is all I have to say on the subject.
The Judge Advocate asked the accused, if he was present at the
time the examination of the Witnesses was made at Lavaca?
He stated that he was and understood what they were doing but
could not hear distinctly all their talk. I told Mr. Graham at the
time that he had not told the story truly and not told it right.
The Judge Advocate asked,
Did the Justice of the Peace read over to you what he had writ-
ten? He replied, Yes, Sir.
The statement of the parties being thus in possession of the, Com-
mission, the Commission was cleared for deliberation, and having
maturely considered the evidence adduced, find the accused D. A.
Saltmarsh as follows.
Of the specification Guilty.
Of the Charge Guilty.
and the Commission do therefore sentence the said D. A. Saltmarsh,
"to be confined for the space of twelve months and that at the
expiration of that period be sent beyond the limits of the Confeder-
ate States."
The Commission then adjourned to meet on the 9th Inst. at
9 O'clock A.M.
