Any person convicted of a violation'of this paragraph shall be subject to
the penalties prescribed in section 8, chapter 179, of an " act to regulate the
sale, alienation, removal or transfer of animals in this State, and to require
butchers to report to the police court all animals slaughtered and for other
purposes," passed November 13, 1866. And the provisions of section 4 of
said act are made to apply to the requirements of this order. Offenders may
be brought before a military commissioner for examination, and held to bail
for appearance before and be tried by a military tribunal.
3. It is declared to be an offence for any person to buy or sell any hide of
cattle without a mark or brand thereon, or from which the mark has been
cut or otherwise removed, or the brand defaced.
Every person offending against the provisions of this paragraph shall, for
such offence, be subject to a fine of twenty-five dollars-one-half to the in-
former, and the other half to the jury fund of the county where the convic-
tion may be had-to be recovered before any justice of the peace or military
commissioner.
4. The provisions of this order will not be held to apply to any parties en-
gaged in slaughtering cattle for the market, or for packing, if they shall
have previously complied with the laws of the State in relation to the cattle
purchased or slaughtered by them.

APPENDIX.
The acts referred to in this order are as follows:
CHAPTER XXIII,.
An act to regulate the shipping and slaughtering of cattle.
SECTION 1. Be it enacted by the Legislature of the State of Texas, That
the captains of steamboats or vessels on which cattle are shipped to leave the
State, or the proprietor or proprietors, or agents of the same, or of any slaugh-
tering establisunents, shall keep or cause to be kept a register book in which
the marks, brands, and general description of all cattle, of all ages, received
on said boats or vessels, or slaughtered at said establishments, shall be regis-
tered, together with the names of the person or persons selling them, and
the county from which they were driven.
SEc. 2. That said register, on the first day of each month, or as near
thereto as possible, shall be presented by said captains or proprietors to the
county clerk of the county where said cattle were shipped or establishments
are situated; and said clerk shall keep a register of the same, and the regis-
ters shail at all times be open for inspection; and said captains, proprietors or
clerks, may charge a fee of fifty cents for each and every inspection thereof.
SEc. 3. That a non-compliance with the provisions of this act shall sub-
ject said captains, proprietors or clerks, to a fine not less than ten dollars, nor
more than fifty dollars, for each head of cattle shipped or slaughtered not
registered; and said fine, with proper proof made, shall be recoverable in any
court of competent jurisdiction.
