The validity of tho election on U>M
option in Baylor Qouaty waa orally
argued for and against before the
court this morning. Mullen, the rela
tor, seeks enlargement from custody
through the writ of habeas corpus.
The main gronnd relied upon by bis
counsel iu the insufficiency of notice
to the presiding officers. The case in
this feature boars an analogy to the
Hunt county onse decided at the Gal
vcston term, in whioh the election
was held invalid. A decision wil
probably be. rendered on the neat
opinion day, Saturday next, in the
Supreme Court. In the Court o( Ap
peals the last call of the assign men
waa made, albo the motion docket o
the seoond aasignmeut, Tomorrow
the first call of the seoond assignment
will be the order of business in both
courts.

niSTUIOT OOUttT,
The case of tho State of Texs* vs
Squire Higgins, was called in the
Distriot Court this morning, and apon
application was oontinued until this
15th of May.
The case of the State of Texas vs.
Bill Davis, chsrged with an assault to
murder, was oalled after the oontinu
ing of the Higgins'case, and is now
progressing.
The evidence and argument in the
ease will probably consume all the
afternoon.
The court will hold an evening
sion, in whioh it is probable that a di
vorce snit will be oalled for trial.
Theeivfl docket, whioh is tobe
taken op and beard before lodge
Williams, is quite an extensive one,

The county clerks offioe has been
rather quiet for several d ays.
The Justice Court has had but little
before it today, and the Judge haa
•mused himself by talking to
friends. •.
Business has been rather still at
Judge Gregg's offioe.
