the other the same thing was likely In

Hempstead which Is tho county seat
of this (Waller) county presents at this
time quite a lively and a btHncss ap-
pearance. This may perhaps he ac-
counted for by two causes viz: One Is
that this being n great cotton-producing
country as well as corn etc. the farm-
ers nro ducking Into town with their
various products which at this time
11 ml a ready market. There Is still an
other reason which accounts for the
town having such an active and html-ness-llke
appearance and that Is that
he district court Is In session and has
been for tho past two weeks with the
probabilities of remaining so for an
other week owing to the Importance

now pending nnd which will he ex-
plained In a subsequent paragraph.
Thero bavo been since the court com-
menced a great many cases ol a petty

criminal dockets but on last Thursday
evening at 3 o'clock commenced one of
tho most Important cases that has ever
come under the notice of the people of

one of the parties interested Is no less a

II. MuNelly formerly of the ranger
force nnd one whose name was a house-
hold word throughout tbe whole state of
Texas and a terror to the evil-doers and
border ruffians of tho Wo Grande.

stands In the court-house of Hempstead
charged with the following serious
crimes nnd It Is to be hoped that on
account o tne good nnme oi uis respect-
ed father who has rendered this state
such valuable service and his allllcted
mother who Is here watching tbe pro-
gress of tbe trial as each day passes
over that he will vindicate himself of
such grave offenses.
In order that your readers may form
some Idea as to tho seriousness and the
unfortunate position this young man Is
placed In the following are copies of
tbe Indictments found by the grand Jury
In Washington county:
First assault with intent to rape.
Second assault with intent to murder
G. Dearson husband of Mrs Dearson
Third maiming.
The party who figures In tilt' case as
complainant is a German woman living
with her husband the mother of eight
children and Is also a grandmother and
residing near the pleasant little town or
llurtoo.on tbe Austin branch of the
'Texas Central railroad. As stated be-
fore this crime which young McNel-
ly is cnargen witn was commuted in
Washington county and owing to the
feeling and excitement which existed
there It was deemed advisable by his
counsel to remove tho case to another
county which was done nnd hence the
trial here. From the evidence thus far
obtained It appears that on the morn-
ing of the Cth of March last between the
small hours of 2 and 3 o'clock- three

before and wound up by arriving nt the

lace assaulted dragged her from her
ed and Indicted several Injuries one of
which being that tbe nipple of one of

In the struggle which occurred the
husband of the woman who had come to
her assistance also received some very
severe Injuries which bad tho etrect of
laying him up lor about six weeks.

A great many witnesses both for the
prosecution nnd defence were produced
to testify as to their truth and veracity
and the woman's (Mrs. Dearson's) repu-
tation as to virtue but there seemed to
be nothing dellulto proven on these
points.
The most Interesting evidence given In
this respect was that of a young
man who being asked If he ever
had any Intercourse with Mrs. Dear-
son replied In the alDrmatlve but
later on In tbe day when the complain-
ant (Mrs. Dearson) was put on the stand
she swore that she bad nover before seen
or heard of him and at this point tbe
young man was led Into court for her to
IdentTfy.but she failed to do so positive-
ly swearing tbat she bad never heard of
seen or spoken to him in her life before.
