by and now existing against the Nocona Independent School District
of Montague County, Texas, comprising the territory described in
Section 1 hereof, are legally imposed upon the district herein created,
to be executed and discharged by it; the same Nocona Independent
School District of MIontague County, Texas, herein created shall be
held to have assumed the discharge of all such bonds, obligations,
contracts and indebtedness, and the same shall be enforceable and
collectible from, paid off and discharged by the said district in the
same manner as if it were a bond, obligation, contract or indebtedness
created by it.
SEC. 21. To facilitate the prompt collection of taxes levied and
assessed against the taxable property within said district, and to
avail said independent school district of its lien heretofore upon any
property delinquent for taxes, the board of trustees may at its discretion
waive the regular proceedings by law for the enforced collection
of taxes, and adopt the extraordinary remedy of direct suit therefor
against the owner of the property so delinquent, and for the foreclosure
of the lien in the form of a suit for debt and foreclosure according
to the statutory provisions in such cases, obtaining service
upon the defendant or defendants in such suit in the manner now
prescribed by general law. Such suit or suits shall be instituted and
prosecuted in the name of the Nocona Independent School District
of IMontague County, Texas.
SEC. 22. The local maintenance taxes heretofore voted by the
qualified voters in any territory included with the independent school
district hereby created are hereby validated and continued in such
territory and the district hereby established until such time as a majority
of the qualified tax paying voters of this district shall increase,
diminish or abolish same as is required under the general statutes of
this State.
SEC. 23. As the district hereby created will have to supplement
its apportionment from the State and county school funds by local
taxation in order to maintain its schools for the scholastic year beginning
September, 1921, any tax voted, as provided by the General
Laws of this State, during the current year 1921 for the maintenance
of the schools in the district hereby created shall be and hereby is
made collectible for the current year 1921, and all subsequent years,
and may be assessed, levied and collected on or before the 31st day
of January after such election, and thereafter annually, as provided
by the General Laws of this State until the tax paying voters of
this district shall increase, diminish or abolish same as provided
under the General Statutes of this State.
SEC. 24. The treasurer of the Nocona Independent School District
of Montague County, Texas shall be that person or corporation
who offers satisfactory bond and the best bid of interest on the
average daily balances for the privilege of acting as such treasurer,
the treasurer when thus selected shall serve for two years and until
his successor shall have been duly selected and qualified, and the
bond of such treasurer shall be in double the estimated amount of the
receipts coming annually into his hands. Said bond shall be made
payable to the president of the board of trustees and his successors
