road tax required by Section 5 hereof, on or before the first day
of each year as provided in this Act, shall be liable and it is hereby
made their duty, to work on, repair and clear out the public roads
of the commissioners' precinct in which they reside, under direction
and supervision of the road commissioner of such precinct (or under
the direction of some other person duly authorized by such road
commissioner) for five days in the year.
SEC. 7. Every commissioner shall be required to procure a list
of all persons liable to road duty and residing in his precinct on
or before the first day of January of each year, which said list
shall be examined and approved by the commissioners' court, and
turned over to the tax assessor, who shall place same on a separate
roll and then deliver such roll to the tax collector and the tax collector
is hereby required to furnish a monthly statement of such
moneys collected thereunder, and after February 1 of each year, said
tax collector shall furnish the commissioners' court a list of persons
failing to pay such road tax, specifying the precinct in which they
were assessed. For such services, the tax assessor and tax collector
shall each receive the sum of ten dollars per year out of the road
and bridge fund of the county.
SEC. 8. Any person becoming liable to road duty in Liberty
County under the General Laws of the State, after the first day of
February of any year, shall have the right to be exempt by paying
to the tax collector or to the county commissioner as road cominissioner
of the precinct in which he resides, to be turned over to the
tax collector as soon as practicable, taking receipt for the same, the
road tax herein provided for.
SEC. 9. In addition to the other powers herein given, the commissioners'
court may dispense with the apportionment of road overseers
in any or all of the commissioners' precincts of Liberty County
and in lieu thereof, may let the work on any or all the public
roads, bridges, etc. by private contract. When work and improvements
of the public roads, bridges, etc. is awarded to a private contractor,
it shall be his duty to work all male persons between the
age of twenty-one and forty-five years', who are subject to road
duty, in the precinct in which they live, but no such person shall be
compelled to work for more than five days in each year, and preference
shall be given to roads nearest to the residence of such persons,
if such road is in need of repairs, to be determined by the commiss'oner
of such precinct.
Si:c. 10. It shall be the duty of each county commissioner to
furnish the contractor with a list of names of all persons not exempt
from road duty, whereupon it shall be the duty of said contractor,
or some person appointed by him, to summons the hands
to work upon the public roads, such notice to be given as provided
by the General Law.s of the State of Texas. Said contractor shall
I'e liable to the commissioners' court for the sum of one dollar per
day for each person subject to road duty, for each person he fails to
work upon the public roads, to which such person has been required
or appointed to work, not to exceed five dollars for each person in
one road year, and it shall be the duty of the county commissioner of
his respective precinct to designate the hands to work each particular
road, and such contractor shall summons or cause to be summoned
