Chapter 544 S.B. No. 1652
1 AN ACT
2 relating to the transfer of certain state property from the Texas
3 Department of Criminal Justice to Mitchell County.
4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
5 SECTION 1. (a) Not later than the 30th day after the
6 effective date of this Act, the Texas Department of Criminal
7 Justice shall transfer to Mitchell County the real property
8 described by Subsection (e) of this section.
9 (b) Mitchell County shall use the property transferred
10 under this Act only for a purpose that benefits the public interest
11 of the state. If Mitchell County uses the property for any purpose
12 other than a purpose that benefits the public interest of the state,
13 ownership of the property automatically reverts to the Texas
14 Department of Criminal Justice.
15 - (c) The Texas Department of Criminal Justice shall transfer
16 the property by an appropriate instrument of transfer. The
17 instrument of transfer must:
18 (1) provide that:
19 (A) Mitchell County use the property only for a
20 purpose that benefits the public interest of the state; and
21 (B) ownership of the property will automatically
22 revert to the Texas Department of Criminal Justice if Mitchell
23 County uses the property for any purpose other than a purpose that
24 benefits the public interest of the state; and
