all the rights, powers, privileges and duties as are conferred and
imposed by the General Laws of the State of Texas upon trustees
and boards of trustees of independent school districts.
SEC. 4. As soon as may be practicable after the taking effect
of this Act, the county judge of Archer County, Texas,
shall, without the necessity of a petition addressed to him for
that purpose, order an election to be held in said school district
for the purpose of electing seven trustees of said school district,
and the said county judge shall issue his notice of said election
by causing a copy of his order thereof to be posted in three
public places within the boundaries of said school district as
herein defined for ten days prior to the date fixed for said election
in said order. The terms of office of the seven trustees
chosen at the first election held under this Act shall be divided
into two classes, and the members of said board of trustees so
selected shall draw the different classes, the three members of
said board of trustees drawing numbers one, two and three
shall serve until the next regular election of trustees of independent
school districts to be held as otherwise provided by the
General Laws of this State on the first Saturday in April, 1925,
and until their successors have been duly elected and qualified,
and the four members of said board of trustees drawing numbers
four, five, six and seven shall serve until the regular election
of trustees for independent school districts to be held as
otherwise provided by the General Laws of this State on the
first Saturday in April, 1926, and until their successors have
been duly elected and qualified; and regularly thereafter the
trustees of said school district shall be elected alternately three
trustees one year and four trustees the succeeding year as
otherwise provided by the General Laws of this State applicable
to independent school districts. And, it is herein expressly provided
that in the event of a vacancy or vacancies of any member
or members of said board of trustees caused by resignation
or otherwise, that the remaining members of said board of trustees
are hereby empowered to appoint any qualified person or
persons to fill such vacancy or vacancies.
SEC. 5. The board of trustees of the school district created
by this Act shall be a body politic and corporate in law, and as
such, may contract and be contracted with, may sue and be
sued, may plead and be impleaded in any court in this State of
compentent jurisdiction, and may receive any gift, grant, donation
or devise made to or for the use and benefit of the public
free schools in said school district.
SEC. 6. The title to all the properties vested in, belonging to
and accrued to the heretofore existing Holliday Consolidated
Common School District No. 6 of Archer County, Texas, and all
properties held in trust by any person or persons for the use and
benefit of said heretofore existing Holliday Consolidated Common
School District No. 6, are hereby divested out of the said
Holliday Consolidated Common School District No. 6 of Archer
County, Texas, and out of any and all such persons holding the
