CHAPTER 1040 H.B. No. 1078 1 AN ACT 2 relating to the election of directors of a soil and water 3 conservation district. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. Section 201.073(a), Agriculture Code, is amended 6 to read as follows: 7 (a) Except as provided for the initial election of 8 directors, the persons who are eligible voters and own land in a 9 conservation district are entitled to elect the directors for the 10 district. For that purpose, the eligible voters shall meet each 11 year on a date and at a time and place designated by the existing 12 board of directors. The directors shall designate for the election 13 a date that is after September 30 and .before October 16. Before 14 [BPein]~ July 15 of each year, the directors shall designate a date, 15 time, and place for that year's election of directors. 16 SECTION 2. (a) This Act takes effect immediately if it 17 receives a vote of two-thirds of all the members elected to each 18 house, as provided by Section 39, Article III, Texas Constitution. 19 If this Act does not receive the vote necessary for immediate 20 effect, this Act takes effect September 1, 2003. 21 (b) This Act applies only to a designation of an election 22 that occurs on or after the effective date of this Act.
