CHAPTER 195 H.B. No. 2031 1 AN ACT 2 relating to the regulation of stormwater management by certain 3 counties. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. Section 423.001, Local Government Code, is 6 amended to read as follows: 7 Sec. 423.001. COUNTY OR DISTRICT SUBJECT TO CHAPTER. This 8 chapter applies only to: 9 (1) a county with a population of 2.8 million or more; 10 [0*] 11 (2) a district or authority created under Section 59, 12 Article XVI, Texas Constitution, that: 13 (A) has boundaries coterminous with a county 14 described by Subdivision (1); and 15 (B) is authorized to provide stormwater drainage 16 and flood control facilities; or 17 (3) a county with a population of more than 1.3 million 18 for which the primary source of drinking water is an underground 19 aquifer. 20 SECTION 2. This Act takes effect immediately if it receives 21 a vote of two-thirds of all the members elected to each house, as 22 provided by Section 39, Article III, Texas Constitution. If this 23 Act does not receive the vote necessary for immediate effect, this 24 Act takes effect September 1, 2003.
