CHAPTER 685 H.B. No. 2579 1 AN ACT 2 relating to the extended hours of sale for mixed beverages and beer 3 in certain cities. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. Sections 105.03(c) and (d), Alcoholic Beverage 6 Code, are amended to read as follows: 7 (c) In a city or county having a population of 500,000 or 8 more, according to the last preceding federal census, a holder of a 9 mixed beverage late hours permit may also sell and offer for sale 10 mixed beverages between midnight and 2 a.m. on any day. 11 (d) In a city or county having a population of less than 12 500,000, according to the last preceding federal census, the 13 extended hours prescribed in Subsection (c) of this section are 14 effective for the sale of mixed beverages and the offer to sell them 15 by a holder of a mixed beverages late hours permit: 16 (1) in the unincorporated areas of the county if the 17 extended hours are adopted by an order of the commissioners court; 18 and 19 (2) in an incorporated city or town if the extended 20 hours are adopted by an ordinance of the governing body of the city 21 or town. 22 SECTION 2.
