RELATING TO JURISDICTION OF THE COUNTY COURT
OF HUTCHINSON COUNTY.
TI. B. No. 346.] CHAPTER 58.
An Act relating to the jurisdiction of the county court of Hutchinson
County, conferring upon said court civil and criminal jurisdiction;
conforming the jurisdiction of the district court of said county, to such
change; and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. Hereafter the County Court of Hutchinson County
in this State, in addition to its present jurisdiction, shall have
civil and criminal jurisdiction as provided by General Law for
county courts. Any and all cases pending in the district court
of Hutchinson County which under the law after the taking effect
of this Act should be pending in the County Court of
Hutchinson County, be and the same are hereby transferred to
the County Court of Hutchinson County, and all writs and processes
relating to any such cases are hereby made returnable
to the next term of the County Court of Hutchinson County,
The district clerk of Hutchinson County shall make the proper
transfer of all cases hereinbefore provided for to be transferred,
and shall make proper entry of such transfer upon his
docket, and shall deliver over to the county clerk all necessary
papers and files.
SEC. 2. This Act shall not be construed to in any wise, or in
any manner, effect judgements heretofore rendered by the
district court pertaining to matters and causes which by this
Act are made returnable to the county court, and the clerk of the
district Court of said county shall issue all executions and orders
of sale and proceedings thereunder, which shall be as valid
and binding to all intents and purposes as though the change
had not been made as directed in this Act.
SEC. 3. The jurisdiction of the District Court of Hutchinson
County shall be such as is provided by the Constitution and
General Laws of this State consistent with the change in the
jurisdiction of the county court herein made.
SEC. 4. The fact that in Hutchinson County the county
court should have civil and criminal jurisdiction in addition to
jurisdiction of a probate court, creates an emergency and an
imperative public necessity that the constitutional rule requiring
bills to be read on three several days in each House be suspended
and that this Act shall take effect and be in force from
aid after its passage, and said rule is suspended, and it is so
enacted.

House, 101 yeas, 0 nays; passed the Senate 28 yeas, 0 nays.]
