policies in force, providing regulation
of increasing rates or adjusting rates
on policies in force; amending Article
14.23 of the Insurance Code, as
amended, by adding thereto Section 5
providing that any increase in rates
on policies in force shall not be
placed in effect without certain ad-
vance approval of the State Board of
Insurance; amending Article 14.25 of
the Insurance Code, as amended, by
adding thereto Section 1 providing
that all companies or associations op-
erating under the provisions of Chap-
ter 14 of the Insurance Code, as
amended, except assessment-as-
needed companies or associations,
shall divide in a prescribed manner
certain assessments or premiums,
when collected into at least two des-
ignated funds, providing for the
method of allocation of premiums be-
tween said funds on life policies,
providing for authorized expenditures
from said funds, providing certain
required premiums be deposited to
the mortuary fund on life policies
issued after the effective date of this
Act and on all life policies now exist-
ing upon which the rates are
increased, specifying the authorized
expenditures from said funds, limit-
ing the expense loading upon certain
life policies upon which rates are in-
creased unless otherwise approved by
the State Board of Insurance, regu-
lating and prescribing the division of
premiums between funds for certain
life policies in force on December 31,
1965, and upon all health, accident,
sickness and hospitalization policies,
providing other procedures as to di-
vision of premiums on existing poli-
cies between funds; amending Article
14.25 of the Insurance Code, as
amended, by adding thereto Section
2 providing that the provisions there-
of shall apply to certain companies
or associations operating upon an as-
sessment-as-needed basis, providing
for division of premiums collected,
by such companies between funds;
amending Article 14.25 of the Insur-
ance Code, as amended, by adding
thereto Section 3 requiring each
company or association to provide in
its bylaws certain provisions relating
to division of premiums received;
amending Article 14.25 of the Insur-
ance Code, as amended, by adding
thereto a Section 4 authorizing the
investment of the mortuary fund and
expense fund of each company or as-sociation in certain investments and
securities; amending Article 14.25 of
the Insurance Code, as amended, by
adding thereto Section 5 providing
for the use, expenditure and invest-
ment of mortuary funds and expense
funds of each company or associa-
tion; amending Article 14.25 of the
Insurance Code, as amended, by add-
ing thereto Section 6 providing for
the payment of cost of defending
contested health, accident, sickness or
hospitalization claims from the mor-
tuary or claim fund under certain
conditions; amending Article 14.25 of
the Insurance Code, as amended, by
adding thereto Section 7 providing
certain limitations on rate increases
on life policies issued after the ef-
fective date of this Act; repealing
conflicting laws and parts of laws to
the extent of such conflict; providing
for a severability clause; and declar-
ing an emergency.
