Toys Guaranteed Refund

WASHINGTON (AP) - Per-
sons who buy dangerous toys or
other banned hazardous sub-
stances would be ginranteed
refunds under a two-year-old
proposal revived by the Food
and Drug Administration.
The revival of the proposal,
announced Friday, was spurred
by a Ralph Nader lawsuit.
Under the 1970 Child Protec-
tion and Toy Safety Act, an
amendment to the Hazardous
Substances Act, the FDA had
banned 833 types of toys, paint
with more than .5 per cent
lead, most Class B fireworks,
drain cleaners with more than
10 per cent sodium or potas-
sium hydrochloride, silver pol-
ishes with cynaide, carlon
tetrachloride for home use, as-
bestos in garments and the wa-
ter-proofing compound X-33.
The proposed regulation
would require manuiacturers of
banned toys or substances to
notify dealers of the govern-
ment action. The dealer would
have to post prominent notice
of the banned articles for 120
days in his store.
Customers returning such a
product would be entitled to re-
fund of the full purchase price,
if proof of sale is submitted, as
well as "any reasonable and
necessary transportation
charges incur red in its return."
If the customer lost his sales
slip, the dealer or manufac-
turer would be required to re-
fund only the wholesale price
plus transi>ortation costs.
The dealer, in return, would
be reimbursed for the amount
he paid for the product by the
manufacturer or the importer.
In his lawsuit, Nader charged
that the FDA had tailed to pro-
mulgate refund regulations re-
quired three years ago by Con-
gress.
