Anti-Trust Bill Passed;
of
The following is the full text
the anti-trust bill as it has been re-
vised by tbe free conference commit-
tee, the amendments which haye been
added by said committee being in-
cluded. This bill has been adopted
by the house, thS vote having been
recorded on Friday. This senate a-
dopted the report and the bill as it
will reach the governor will read as
follows:
Section 1. Any corporation organ-
ized under the laws of this or aiiy
tither state or- country, and transact-
ing or conducting any kind of busi-
ness in this state; or any partnership,
or individual, or other association of
pefsous whatsoever, who shall create,
ehteir into, become a member of or a
party to any pool, trust, agreement,
combination, confederation or under-
standing with any other corporation,
partnership; individual or au£ other
person tit association Of persons, to
regulate or fix'the price of merchan-
dise, commodity, convenience, repair,
any product of raining or any article
or thing whatsoever, or tbe price ot
premium to be paid for i&suring prop-
erty against loss or damage by fire,
Kgktniug or etofm or to maintain
said price when fio regulated or fixed,
or shall enter into; become a jnmnbef
of tit a party to any pool, agreement,
combination; ctintrast, association or
confederation to fix or liriiit the a-
mount or quality of any article of
manufacture, meCbauism, merchan-
dise, commodity, convenience, repair
ahy product Of mihing or any article
or thing whatsoever, br the price or
premium to be paid for insuring prop-
erty against loss or damage by fire;
lightning, storm; cyclone, tornado or
any other kind of policy issUed by
any corporation, partnership, individ-
ual br association of persons afore-
said, shall be deemed and adjudged
guilty of a conspiracy to defraud and
to be subject to the penalties as pro-
vided by this act. . * 9
Sec. 2, A "monopoly" is any unibn
or combination or consolidation or
affiliatibn Of capital, credit, property,
assets, trade, custom, skill of acts, or
of any other valuable thing or posses-
sion by or between persbns, firms or
corporations, associations of persons,'
firms or corporations, whereby 6hy
one of the purposes or objectsx^ui
tioned in this act is accomplishes
sought to be accomplished, or where-
by any one or more of said purpbljs
are pfoinoted or attempted to be
ecuted pr carried out, or wberebV'the
several results described herein are
reasonably calculated lb be propuCed I
and a ''monopoly," as thus defined
and contemplated; includes not mere-
ly sUCh combinations by ind between
two or more persons, firms or corpor-
ations acting for themselves, but is
eipecially defined and intended to
include all aggregatiops, amalgama-
tions, affiliation, consolidations or
incorporatibhs of capital, skill, credit;
aasbts, property, custom, trad^ot oth-
er valuable thing or possession,
whether effected by the ordinary
methods bf partneredip ot by actual
union under the legal form of a cor-
porated body resulting from the union
of che or more district firms or cor-
poration^ br by the purchase, acqui-
sition or -control of shares or certifi-
cates of stock br bonds or other fecif-
porate property br franchises; and all
corpbrations or partnerships that
have been or may bo created by the
consolidation or amalgamation of the
separate capita), stock, bonds, assets;
credit, properties,- custom; trade br
corporate or firm belongings of two
or more firms or corporations or co'ril-
panies are especially declared to'
constitute monopbles withiu the
meaning bf this act,1' if sb cfeated or
or entered into for any one or ihore
of the purposes named in this ctcti
and a "monopoly" as defined in this
section is heteb^ dasiared W W t&i-
lawful and against public polcy and
any and all persons, ? ~r>9, corpora-
tions or associations of persons en-
gaged therein shall bo deemed and
adjudged guilty of a conspiracy to
defraud, and shall bo snbjeCt to the
penalties proscribed in this act.
Sec. 3. If any persou, persons,
corupanv, partnership, association or
corporation, engaged in tho manu-
facture of any article of commerce or
consumption from the raw material
produced or mined iu this state; shall
with the intent or purpose of driving
out competition, or for tho purpose
of financially injuring competitors,
sell at less than the cost of manufac-
ture, or give away thei manufactured
products, for the pUrpose of driving
out competitoU or financially iujurrng
competitors engaged ic the manufac-
ture and refinibg of raw material in
tbis state, said persou, persons, corh-
pany, partnership, association or cor-
poration resorting to ibis Method of
securing a monopoly ib the manufac-
ture, refining and sale of the finished
product produced Or mined in. this
state, shall be deemed guilty of a
conspiracy to form or secure a trust
or monopoly in restraint of trade and
on Conviction shall be subject to tho
penalties of this act.
3. Sec. 4. If any parson, persous;
Company, partnership, association,
Corporation or agent engdged in the
manufacture br sals of any article of
commerce or consumptioh produced,
manufactured or mined in this state
or elsewh&ire, shall with the intent or
purpose of financially injuring coih
petition, sell Within this statb at less
than cost of manufacture oir produc-
tion, or sell in such d «vay, or give
away within this state their products
for the purpose of driving out compe-
tition or financially iujuriug competi-
tors ehgaged in similar business, said
j>crson, persons, company, partner-
ship; association, corporation or agent
resortiug to this method of securing
a monopoly Within this state in such
business, shall be deemed guilty of a
conspiracy to form or secure a trust
or monopoly in restraint of tirade, aiid
on conviction thereof shall be subject

Sec. 5. Any person, partnership,
firm or assdeiatibn or aiiy representa-
tive or agent thereof, or any Corpora-
tion or company, or tidy officer; repre-
sentative br agent thereof, violating
any ot the proyisions of this act shall
forfeit not less thau $200 not ihore
than $5000 for every siich offense; and
each day such pefsbu; corporation,
