entitled suit filed in the District Court of said coun
ty o' Harris. her petition alleging herself to be a
resident of said couutv and i ompiaining of Eben-
eser B. Nichols and Susannah Earl, residents of
the county ai Galveston in this State, C. W. Buck
ley vnd Mary Jane Hooper residents of the county
cr Fort Bend, in said State, John Moore, a resi-
dent of the county of Robertson, in said State, John
W Bergin. Joseph Harris, Ellen Capehart, Rose
Capehnrt, Philip Capehart. Archibald Pratt, Albert
Pratt, Mary Pratt and Sarah Pratt, residents of the
county of Farris, aforesaid, Elisabeth Anderson
who is aliegsd to be absent from the State, James
Earl, Thomas Wm Earl , Elisabeth Ann. Xarl and
Wm Capehart, whose residences are alledged to be
unknown and the children and legal representa-
tives of Alienor:! Connelley dee'd. whose names and
residences are alledged to be unknown, all of whom
are made defendants in the aforesaid suit, setting
forth and alleging a complaint of which the follow-
ing is a brief statement, to wit: That petitioner's
father, lhonn s Barl departed this lile about the
month of July, A. D. 1850, leaving his last will and
testament, which has since been duly admitted to
to probate, in which the said Ebeneter B. Nichols,
C. W, Buckley and the testator's son Thomas were
made executors, and bequeathing the landea estate
ofthesaid testator, as set forth in the following
clause of said will to-wit:
"I will and bequeath my landed estate, to be divi-
ded into eight equal parts and equal as to quan
tity and quality as nearly as poss ble to be divi-
ded among uy chi dren and grand-children as
follows: one Jot or parcel to BUen Jane Hooner,
daughter of Elisabeth Pratt dee'd. one lot or par-
. eel to Mary Aon ■ ratt, one lot or parcel to Jane
Wells, one lot or parcel to Francis Capehart, one
lot or parcel to my son Thomas, one lot or parcel
to the children of my deceased son James one lot
or parcel to my infant daughter Susannah."
That said executors were authorized by said will
to divide said landed estate among said heirs, and
in case said landed estate could not be qeuilably di
viaed according to the provisions of said wiii, then
said executors, or any two of them were authorised
by said wiU to sell said landed estate and divide
the procreds among said heirs or their legal repre-
sentatives. That said testator died seisedand pos-
sessed of four thousand six hundred and Ave acres
of land, less three hundred acres, situa ed on the
south side of Buffalo Bayou, in the said county of
Harris, said land being trie same granted to the said
testator 07 the Mexican Government. Th.t the
said Thomas, one or the executors aforesaid h is
sinc%deceai>ed that the other executors aforsaid
iavewhollv failed to divide and dispose of said
land according to the provision o( said wiilandtha:
from the neglect of duty have for'eUerl their right
to said trust. That petitioner is the identical Jjuc
Wells who is mentioned a: one of the Devisees in

and Suaanash Earl, are the same persons, who are
mentioned as devisees in said wiii and that the said

dee'd. and that said Archibald Pratt. Mary Pratt,
Albert Pratt,and - a rah Pratt, who are minors and
herein made defendants are the children ofthesaiu
dee'd . that the said ?r ncis Capehart, one of the
devisees In said will is dee'd, and that the said
Ellen Capehart. Rose Capehart, John Capehart.
Phillip Cape haak and William Capehart, who are
miners and herein made de.endants are the chil-
dren of the said dee'd. That the said Thomas Earl
dee'd. one of the devisees in said will, iefttbe said
Elisabeth Ann Barl, and Thomas Wm. Earl, his
children who are minors ani herein made defen-
dants. Thai the children of the said James Earl,
dee'd, who are devisees in said will are the said
JaairsEarl and John Bar', who are minors and
herein made defendants, and the children of the
said testator's decerted daughter Catharine.who are
devisees in said will, are the said John vioore, Jo-
seph Harris, Elizabeth Anderson, and Alienora
Connellaj the latter of whom are dee'd and thatsaid
dee'd, left children whose names and residences are
unknown to petitioner, all of whom are made defen
dants. That it is impossible to make a fair and
equitable division of said land among the varions
parties entitled thereto that the said minor e'efen
dants hare no other property for support and educa-
tion. That it wor ld be greatly to the benefit of all
parties concerned to have aaid land sold and the
proceeds divided among the parties entitled thereto
aa aforesaid. Petitioner prays that the said tion
Court in the exercise of its equitable jorisdiction
appoint some proper sad discreet person or persons
to act as trustee or trustees to sell said laad on such
terms as said court may deem proper te prescribe
and that the proceeds of said sale be paid over to
theparaes entitled by law to receive the same and
that shares of said proceeds, that may be coming to
said minors be expended under the direction of the
said Court to their education and sapport,and prays
that all the said defendants be cited to appear at the
next term ef the said Court and show cause if any
they have, why the relief asked for in this peti-
tion may not be granted. And that whereas Jane
Wells, the nlaintiff aforesaid has made affidavit ac-
cording to lar, that the names and residences of
the children of the Alienors Connelley dee'd, are
unknown to plain tiff that the residences of the said
Wm. Capehart, oae of the minor children of Francis
Capehart and James Earl, and John Earl children of
the siid James Barl. aad who are minors, and Elisa-
beth Ann Barl and Thomas Wm Earl, tfhlldren of
Thomas BarMec'd. who are minors are all unknown
to plaintiff and that the said Elizabeth Anderson, is
