The Comptroller of Public Accounts is proposing to repeal
Rule 026.02.06.031. Subsequent to the promulgation of this
rule, the motor vehicle retail sales and use tax was amended
to clearly exempt the purchase of motor vehicles by public
agencies; the change has rendered this rule unnecessary.
Therefore, this repeal is proposed to eliminate this unneces-
sary rule. The repeal will not result in a substantive change
in any administrative policy.
There are no significant fiscal implications expected from the
proposed rule (source: revenue estimating staff, Comptroller
of Public Accounts).
Public comment on the proposed repeal of Rule .031 is in-
vited. Persons should submit their comments in writing to

The repeal is proposed under the authority of Texas Taxa-

The Texas State Board of ('ontrol is proposing to amend Rule
028 13 01 507, relating to use of conference rooms in the
Capitol ('onple-x under its management and control The
Building and Property Services l)ivision of the board exer-
cises its control over state-owned property on the inventory of
the board pursuant to the authority of Articles 665. 667,
673-676, 678d 1, 678e, 678f, fi78m.In, and 6252-6, Vernon's
Texas Civil Statutes
The proposed amendments to Rule 5117 would require that
special arrangements for use of furniture, mnwcrophones, etc.
he made in advance to allow board work forces to hbe properly
scheduled (R'ile .507(4)); allow reservations to be made ver-
bally under certain circumstances .Rule .507(18); and require
notice of cancellation of a reservation (Rule .507(9)).
The Board of Control does not anticipate that the proposed
amendments to Rule 507 will have any state or local fiscal
implications.

within 30 days from publication in this Register.
These amendments to Rule .507 are proposed under the
authority of Articles 665, 667, 673-676, 678, 678d-1, 678e,
678f, 678m, and 6252-6, Vernon's Texas Civil Statutes..507. Conference Rooms. Use of conference rooms in the
Capitol Complex under control of the Board of Control shall
be permitted under the following guidelines:
(1)-(3) (No change.)
(4) Special arrangements of furniture may be pro-
vided by the Board of ('ontrol as schedules permit. Special
arrangements of furniture by Board of( ontrol forces and
use of microphones and public address systems in (3)
above must be requested at time of reservation or at least
one day prior to need to allow' scheduling of work forces to
arrange furniture and to assure proper operation of
microphones and public address systems at time of con-
ference. Occupants may rearrange tables and chairs that
are moveable to suit their desires Hlowever, large podiums or
affixed furniture shall not be moved.

mitted but must be confirmed in writing to the Building
and Property Services Division within tao working days
of making the reservation. o verbal reservation can
hold a conference room if a written request from another
agency or authorized person is recei -d prior to confirma-
tion and cannot be filled any other way.
(9) ( 'aneellations of reservations arc to he made
as soon as possible' after on agency le(arns. that the room
will not be needed, so that conference rooms can be freed
for use by other agencies and so prer ent possible expen-
ditures of state funds for rental of public conference
facilities. Verbal cancellation, must be confirmed in uwrit-
ing within tu o working days following the cancellation.

028.13 02 553d , re-la:ting to obtaining lease space from non-
private source, The Leasing Section obtains lease space for
use by state gennci(s under the authority of Article 666b,
Vernon's Texas ('Civil Statutes.
The current Rule 55:3;d) and the above-cited Article 666b
perm t the board to negotiate contracts with certain nonpri-
vote sources. It has been our assumption that the leased
space offered bie owned by a political subd division and not
merely leased iv that authority through noncompetitive
means. We feel that the requirements of' Article 666b, supra,
cannot ie waived directly and should not be waived in-
directly. [Therefore, the 1iard of ('ontrol is proposing to limit
our authority to negotiate Tease I from political subdivisions
to those cases where the space is owned by that authority, or
where the sta.e agency is to be a minor occupant of the space
and working cooperatively with the politicial subdivision to
provide centralized services to the general public.
The Board of ('ontrol has determined that the proposal of this
amendment to Rule .553td) will have no knew: fiscal im-
plications for state or local units of government.
