An agency may adopt a new or amended rule, or repeal an ex-
isting rule on an emergency basis, if it determines that such ac-
tion is necessary for the public health, safety, or welfare of this
state The rule may become effective immediately upon filing
with the Texas Register, or on a stated date less than 20 days
after filing for no more than 120 days The emergency action
is renewable once for no more than 60 daysAn agency must submit written reasons, published in the
Register, for emergency action on a rule. The submission must

Chapter 175. General Rules of the
Veterans Land Board
40 TAC 175.20
The Veterans Land Board adopts on an emergency
basis 175 20. concerning the processing of loan ap-
plications to buy tracts within a subdivision The pur
pose of this new rule is to make more land available
to veterans in Texas, to reduce the number of days
required to close a loan, and to simplify the board's
loan processing procedures fhe Veterans Land Board
adopts this rule on an emergency basis because of the
tremendous increase in interest in the Veterans Land
Program and the need to handle the transaction as ex-
peditiously as possible
The new rule is adopted on an emergency basis under
the Natural Resources Code, 161 063, which autho-
rizes the Veterans Land Board to adopt rules that it
considers necessary or advisable in the administration
of the Veterans Land Act
175.20. Suhdi sion Ioan Processing.
(a) To qualil~ for subdivision loan processing, a
seller must:
(1) have or plan to have at least five tracts of land
available for sale to veterans in the same subdivision or
development;
(2) agree to comply with all local ordinances and
regulation regarding the subdivision or resubdivision of
land;
(3) agree to provide the services and materials
described in this rule to veterans interested in order to
facilitate the board's processing and closing of loans.Emergency
Rules(b) A written request for subdivision loan process-
ing of an existing or proposed subdivision must be sub-
mitted to the board

best subdiision plan, so as to maimitze land \alues of
the gross acreage for sale.

(d) After the preliminary subdi lsion appraisal has
been completed, and sshen a ,eller indicates that tracts
within a subdslisioi ate ready for sale to veterans, the
seller may make arrangements with the hoard for actual
appraisals of specific tracts. The board wioll commit itself
to a loan value based upon these appraisals ecen though
a specific veteran purchawer has not yet been identified.
To obtain these appraisal,, the seller must.
(1) supply, a ground survey of each tract of land
by a registered surveyor,
(2) obtain a ttl, insurance commitment for each
tract;
(3) request a field appraisal of each tract by the
board. A fee of 120 is charged in advance for each ap-
praisal. This feec will be refunded to the seller if the tract
is sold to a ,eteran through the Veterans Land Program;
(4) fu nish a recorded subdivision plat, if re-
