RESOLUTION
WHEREAS, the National No-Fault Motor Vehicle Insurance Act,
Senate Bill 94 5, is now pending action in the United States Senate,
and,
WHEREAS, said Act effectively destroys the moral and legal
responsibility of a careless or negligent driver of a motor
vehicle to answer to an innocent victim for damages caused by
such conduct, and,
WHEREAS, said Act discriminates against the poor and laboring
people as well as the consumer public as a whole by making it
mandatory that every owner of a motor vehicle purchase a program
of self-insurance from the private insurance industry at a profit
whether the individual needs it, wants it or can afford it and,
WHEREAS, said Act further discriminates against the poor and
laboring people as well as the consumer public as a whole in that
recent reliable actuarial studies show that such Act would result
in higher rather than lower premium rates particularly in Southern,
Southwestern, and Midwest states where such studies show that every
policy premium would be raised to some degree and by as much as
60 percent'in some cases, while limiting the benefits payable to
damaged victims by the insurer, and,
WHEREAS, said Act, in a large majority of cases, destroys the
right of the damaged individual to seek redress in a court of law
against the careless or negligent driver, and,
WHEREAS, said Act, by requiring the passage of these provisions
in each state under penalty of said Act itself, become an automatic
law in each state, is an unreasonable encroachment by the Federal
Government on the rights of each state to reform and regulate its
own system of insurance and automobile damage reparations as the
need may require in each state •
NOW, THEREFORE, BE IT RESOLVED, that the League of United
Latin American Citizens, through its national supreme council,
assembled at the ci-ty of Beaumont, County of Jefferson, State of
Texas, for the reasons above stated, that hereby go on record in
opposition to the passing of Senate Bill 945 , the National No-
Fault Motor Vehicle Insurance Act and other similar legislation
which, by its terms, would result in such detrimental effect on
the consumer public and the right of the individual state to
regulate their own affairs in these matters, and,
BE IT FURTHER RESOLVED, that the Secretary of this national
supreme council be instructed to send copies of this resolution
to each and all of the United States Senators, each member of the
United States House of Representatives and the Secretary of the
Department of Transportation of the United States,
