the State and of supervising the business administration of the public
school system. His is the responsibility of deciding all questions that
arise in connection with the internal affairs and management of the public
schools. He hears appeals from the rulings and decisions of subordinate
school officers. From his decisions, appeal lies to the State Board
of Education.8 As a rule, exhaustion of remedies through these channels
of appeal is a condition precedent to the exercise of jurisdiction
over such cases by the courts.'
The county board of school trustees, composed of five elective members,l0
is an incorporated' board and:in its corporate capacity may, for
school purposes, make contracts, acquire and own property, sue and be
sued, and do all other things necessary in the management of the common
schools in the counties.ll The county superintendent of schools serves
the board as its secretary-.12
Among the duties of the county school superintendent, not already
mentioned, are those of appointing the members of the county board of
school examiners;13 and of apportioning the county's part of the State
available school fund to the common school districts of the county and
the county available fund to the common and independent districts.14
Each common school district has its own board of trustees; board
members are elected from the district.15 The district board is also an
incorporated body, and within the district, has corporate powers similar
to those of the county board.16 It manages and disburses district
school funds,17 has the management and control of the public school
buildings and grounds in the district, determines the number'of schools
the district is to have and their locations, employs teacher, and passes
upon claims made upon district funds.18 It is empowered to make such
reasonable rules and regulations for the governance of the schools of the
district as are necessary.19
