A FAR REACHING DECISION.
Last yoar the Legislature of New
York undertook to prevent by statute
the manufacture and sale of oleomar-
garine. The matter was carriod into
the courts aud the Court of Appoals
has Just deolared the act unconstitu-
tional. Tho court holds that tho sale
of a substitute for any article of man-
ufacture 1b a legitimate business
which If effected without deception
oaunot be arbitrarily suppressed and
that the legislation In question is not
aimed at deception but in ell'oct cre-
ate a monopoly destructive of con-
stitutional rights.
This strikes us as a sound sensible
decision and will serve as a controll-
ing precedont not only in Now York
but iu other States. Adulterations and
deceptions should beproveuted. Whon
oleomargarine is sold for butter or
leaves for toa the seller ought to be
punished aud there isu't a State any
where but has the statutory provis
ions to meet the case. Whon the art!
O'.e is manufactured and sold for just
hai it Is aud nothing olse whether it
ba oloomargarino or strychnine or
whtxky or glucose it Is an infringe
ment on the liberty of tho subject to

decision may be oxpectod In other
fields of manufacture and with great
