No. 988 1 AN ACT 2 relating to compensatory time accrued by a correctional officer 3 employed by the Texas Department of Criminal Justice. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1i. Section 659.015, Government Code, is amended by 6 amending Subsection (g) and adding Subsection (k) to read as 7 follows: 8 (g) Except as provided by Subsection (k), compensatory 9 [C~eAspenfatoey] time off to which an employee is entitled under 10 Subsection (f) must be taken during the 12-month period following 11 the end of the workweek in which the compensatory time was accrued 12 or it lapses. An employee may not be paid for that compensatory 13 time, except as provided by this subsection and Subsections (i) and 14 (j). An employee of an institution of higher education as defined 15 by Section 61.003, Education Code, or an employee engaged in a 16 public safety activity, including highway construction and 17 maintenance or an emergency response activity, may be paid at the 18 employee's regular rate of pay for that compensatory time if the 19 employer determines that taking the compensatory time off would 20 disrupt normal teaching, research, or other critical functions. 21 (k) Compensatory time off to which a correctional officer 22 employed by the Texas Department of Criminal Justice is entitled 23 under Subsection (f) must be taken during the 24-month period 24 following the end of the workweek in which the compensatory time was
