pleting documentation necessary to enroll or make a contribution to a
Texas qualified tuition program plan; and
(2) providing materials relating to a Texas qualified tuition

plan manager or administrator of a Texas qualified tuition program
plan, Texas Prepaid Higher Education Tuition Board, Office of the

(c) Prohibited activities. A charitable organization and its fi-

Texas qualified tuition program plan:
(1) selecting or recommending a particular investment op-
tion; or
(2) receiving a commission or other remuneration.

by legal counsel and found to be within the agency's legal author-
ity to adopt.

Austin, Texas.)
The Texas Department of Housing and Community Affairs (the
"Department") proposes the repeal of 10 TAC Chapter 1, Sub-
chapter A, 1.22, concerning Providing Contact Information to
the Department. The purpose of the proposed repeal is to es-
tablish a new rule to set forth policies and procedures governing
the provision of providing contact information to the Department.
The proposed new 10 TAC 1.22 is published concurrently with
this repeal in this issue of the Texas RegisterFISCAL NOTE. Timothy K. Irvine, Executive Director, has deter-
mined that, for each year of the first five years the repeal will
be in effect, enforcing or administering the repeal does not have
any foreseeable implications related to costs or revenues of the
state or local governments.
PUBLIC BENEFIT/COST NOTE. Mr. Irvine also has determined
that, for each year of the first five years the repeal will be in
effect, the public benefit anticipated as a result of the repeal, is to
establish a proposed new rule which will increase efficiency and
consistency among the Department's Single Family Programs.
There will be no economic cost to any individuals required to
comply with the repeal.
ADVERSE IMPACT ON SMALL OR MICRO-BUSINESSES. The
Department has determined that there will be no economic effect
on small or micro-businesses.
REQUEST FOR PUBLIC COMMENT. The public comment pe-
riod will be held October 4, 2013, to November 4, 2013, to re-
ceive input on the repeal. Written comments may be submitted to
the Texas Department of Housing and Community Affairs, Eliza-
beth Yevich, Rule Comments, P.O. Box 13941, Austin, Texas
78711-3941, or by fax to (512) 475-0070. ALL COMMENTS
MUST BE RECEIVED BY 5:00 P.M. NOVEMBER 4, 2013.
STATUTORY AUTHORITY. The repeal is proposed pursuant to
Texas Government Code 2306.053, which authorizes the De-
partment to adopt rules.
The proposed repeal affects no other code, article, or statute.

This agency hereby certifies that the proposal has been reviewed
by legal counsel and found to be within the agency's legal author-
ity to adopt.
