The amendments are adopted on an emergency basis pursuant
to 2001.034 of the Government Code, which allows a state
agency to adopt an emergency rule if a requirement of state
or federal law requires adoptions of the rule on less than 30
days notice. The Coordinating Board made the finding that the
amendments to these sections should be adopted on an emer-
gency basis, pursuant to 2001.034 of the Government Code,
because House Bill 5 and Senate Bill 31 of the 83rd Texas Leg-
islature passed both houses with more than a two-thirds majority
of all the elected members in each house and were signed by the
Governor. The newly amended statutes will affect students en-
rolling in dual credit courses at public institutions of higher edu-
cation on or after September 1, 2013. The next regular quarterly
meeting of the Board is scheduled for October 24, 2013, which
would not allow public institutions of higher education adequate
time for implementation to be in accord with the effective date of
the bill. Therefore, the amendments to 4.85 must be adopted
on less than 30 days notice pursuant to 2001.034 of the Gov-
ernment Code.
A provision has been added limiting the number of dual credit
courses in which a student may enroll at a community college,
if the community college does not have a service area that in-
cludes the student's high school, to three courses per academic
year. Additionally, a provision was added that restricted the dual
credit courses for which a college could claim state funding to
core curriculum, career and technical education, and foreign lan-
guage courses.
The amendments are adopted on an emergency basis under
the Texas Education Code, Chapter 28, 28.009(b) and Chapter
130, 130.001(b)(3) - (4), which provides the Coordinating Board
with the authority to adopt rules to administer the section.
4.82. Authority.
Texas Education Code, 28.009(b), 29.182, 29.184, 61.027,
[ -76] 130.001(b)(3) - (4), 130.008, 130.090, and 135.06(d) pro-
vide the Board with the authority to regulate dual credit partnerships
between public two-year associate degree-granting institution and
public universities with secondary schools.
4.85. Dual Credit Requirements.
(a) - (b) (No change.)
(c) Location of Class. Dual credit courses may be taught on the
college campus or on the high school campus. For dual credit courses
taught exclusively to high school students on the high school campus
and for dual credit courses taught electronically, public colleges shall
comply with applicable rules and procedures for offering courses at a
distance in Subchapters P and Q of this chapter (relating to Approval of
Distance Education Courses and Programs for Public Institutions and
Approval of Off-Campus and Self-Supporting Courses and Programs
for Public Institutions) [*y)4114 - 418 of this title (relating to Dis-
tance Education and Off-Campus Instruction)]. In addition, dual credit
courses taught electronically shall comply with the Board's adopted
Principles of Good Practice for Courses Offered Electronically.
(1) A student may not enroll in more than three courses per
academic year at a junior college if the community college does not
have a service area that includes the student's high school, except to
the extent approved by the Commissioner of Texas Education Agency.
(2) This provision does not apply to students enrolled in
approved early college high school programs.

(2) The college may only claim funding for [all] students
getting college credit in core curriculum, career and technical educa-
tion, and foreign language dual credit courses.

lated institutions may waive all or part of tuition and fees for a Texas
high school student enrolled in a course for which the student may re-
ceive dual course credit.

been reviewed by legal counsel and found to be within the
agency's legal authority to adopt.

19 TAC 4.211
The Texas Higher Education Coordinating Board (Coordinating
Board) adopts on an emergency basis amendments to 4.211,
concerning financial literacy training. The amendments are
adopted on an emergency basis pursuant to 2001.034 of the
Government Code, which allows a state agency to adopt an
emergency rule if a requirement of state or federal law requires
adoption of the rule on less than 30 days notice.
The Coordinating Board made the finding that the amendments
to 4.211 should be adopted on an emergency basis, pursuant to
2001.034 of the Government Code, because Senate Bill 1590
of the 83rd Texas Legislature passed both houses with more
than a two-thirds majority of all the elected members in each
house and was signed by the Governor, making it effective im-
mediately. The next regular quarterly meeting of the Board is
scheduled for October 24, 2013, which would not allow general
academic institutions adequate time for implementation of the bill
since the institutions will need to offer the course during the 2013
fall semester. Therefore, the amendments to this section must
be adopted on less than 30 days notice pursuant to 2001.034
of the Government Code.
The intent of the amendments are to incorporate into existing
rules other topics that should be included in the financial literacy
course that is provided by the institution.
The amendments are adopted on an emergency basis under the
Texas Education Code, Chapter 51, 51.305, which provides the
Coordinating Board with the authority to adopt rules to administer
the section.
4.211. Topics for Financial Literacy Training.
The topics to be covered in the training shall include, but are not lim-
