CHAPTER 285 H.B. No. 1043 1 AN ACT 2 relating to the offense of the unauthorized duplication of certain 3 recordings. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. Section 641.051, Business & Commerce Code, is 6 amended by adding Subsection (e) to read as follows: 7 (e) This section does not apply to a person engaged in radio 8 or television broadcasting who transfers, or causes to be 9 transferred, a recording: 10 (1) intended for or in connection with a radio or 11 television broadcast; or 12 (2) for archival purposes. 13 SECTION 2. The change in law made by this Act to Section 14 641.051, Business & Commerce Code, does not apply to an offense 15 committed under that section before the effective date of this Act. 16 An offense committed before the effective date of this Act is 17 governed by that section as it existed on the date the offense was 18 committed, and the former law is continued in effect for that 19 purpose. For purposes of this section, an offense was committed 20 before the effective date of this Act if any element of the offense 21 occurred before that date. 22 SECTION 3. This Act takes effect immediately if it receives 23 a vote of two-thirds of all the members elected to each house, as 24 provided by Section 39, Article III, Texas Constitution. If this
