Then came on to be considered the plans and
specifications and bids of different parties for the
erection of a Court House and vault and jail building
pending said investigations. Court adjourned until
tomorrow morning, 9 o'clock A.M.
Wednesday, Sept. 2nd.
Court reconvened pursuant to adjournment, same
officers present as on yesterday.
A suit of injunction having been filed against the
officers of the Commissioners Court, of this County
restraining the said Court from issuing bonds or
from creating any indebtedness against Dickens County
in the erection of the courthouse and jail in Espuela
as heretofore ordered by this Court, and the Hon. W. R.
McGill, Judge of the 50th Judicial District of Texas
which includes the County of Dickens having granted
a temporary injunction against the officers of this
Court restraining them from issuing bonds, or building
or contracting for the erection of the said Courthouse
and jail until further proceedings are had in the
District Court of Dickens County, Texas, in said suit,
Be it Ordered that the County Attorney be authorized
and he is hereby directed, to take the necessary steps
to bring this suit before the Hon. District Judge at
as early a day as practicable on a motion to dissolve
the said writ of injunction and he is authorized to
employ associate counsel should he deem the same
necessary and advisable to aid and assist in the
preparation and defense of the said suit, and the Hon.
A. J. McClain, Co. Judge is authorized to draw on
the special fund for a sufficient sum of money to
meet the necessary expenses of prosecuting & de-
fending this suit, and the Clerk will issue his
warrant on the Co. Treas. for such sum or sums at
such time or times as he may be called upon so to
do by the said County Judge.
It is ordered, that the Road reviewers heretofore
appointed be and they are hereby authorized to employ
a wagon and team whilst they are actually engaged
in making the necessary reviews as heretofore
directed for which they may make an allowance of
$2.00 per day for such time as a team maybe
required and used.
And Whereas, C. M. Buchanan, one of the road
reviewers heretofore selected, has met witha serious
accident from a fall off a horse, be it ordered that
should his injuries be of such a serious nature as
to prevent him from acting as a reviewer of the
Co. Roads, then & in that event the Hon, A. J.
McClain, Co. Judge is authorized to appoint some
suitable person to fill his place.
The bill of Clark & Courts for stationary &
furniture amounting to $2344.95 was examined &
approved and the Clerk will issue warrant for the
same as previous order on page 2,
The D. S. Dunwoody act. for freight & stationary
amounting to 1.00 allowed.
W. B. Hughs is allowed $1.25 for making book case.
J. G. Scott, Commissioner of Precinct No. 2,
tendered his resignation to the Court as a Com-
missioner of Precinct No. 2, and the same is accepted.
The bid of the Dibrell Safe & Lock Co. of Canton,
Ohio, through their agent, P. B. Ligon, for the jail
cage for Dickens Co., being regarded as the best
bid for the interest of the County is hereby accepted,
and the Court agrees to contract for the construction
of the same as the bid made by the said P. B. Ligon,agent, upon the dissolution of the injunction suit now
pending restraining the Court from the erection ofsaid jail building.
Commissioner W. F. Gilbert was excused from
further attendance of this Court for this day, on
account of sickness in his family and it is ordered
that the County Judge, A, J. McClain, Comm. J. A.
Stokes & J. R. Wallen, sign up the contracts for the
construction & erection of the jail cells, for the
Court.
It is ordered that Judge A. J. McClain, Comm.
J. A. Stokes, J. G. Scott, W. F. Gilbert and J. R.
Wallen be and they are each allowed Six Dollars
for 2 days services on the Commissioners Court.
Minutes read and approved and Court adjourned to
reconvene Sept. 22nd, 1891.

Whereas, on the 2nd day of September, 1891,
J. G. Scott, Comm. in and for Precinct No. 2 of
Dickens, Texas, tendered to the Commissioners
Court of said County in writing his resignation as
such Commissioner and when said resignation was
by said Court received whereby reason thereof said
office of Commissioner of said Precinct No. 2 became
vacant, now, therefore, I, A. J. McClain, as County
Judge, of said Dickens County, do hereby appoint
W. J. Duncan, who is a resident citizen of said
Precinct in said Dickens County and a qualified
voter there as Commissioner of said Precinct afore.
said to fill said vacancy occasioned by reason of the
resignation of said Scott.

Proclamation
WHEREAS, an Election was held on the 14th day
of March, 1891, for the organization of Dickens
County, Texas and the Election of the various County
officers and the location of the County Seat of said
County; and
WHEREAS, no place received the requisite number
of votes at said election to entitle it to the County
Seat; another Election was held by order of the
Commissioners' Court of Dickens County, under
Proclamation of A. J. McClain, County Judge, on the
8th day of May, 1891, The places voted for being
Dickens City and Espuela, Dickens City received 58
votes and Espuela received 74 votes; and
WHEREAS, Dickens City being within the 5 mile
radius required a majority of the votes cast to entitle
it to the County Seat and Espuela being more than five
miles from the geographical center of the County
required a two-thirds vote and Dickens City not
receiving a majority of the votes cast in said election
and Espuela not receiving two-thirds of the votes
cast, no place was entitled to be declared the County
seat; and
WHEREAS, Dickens County has no legally elected
County Seat; Now, by virtue of authority vested in me
by Law, I, A. J. Hagins, County Judge of Dickens
County, Texas, do hereby order an Election to be
held in the County on Tuesday the 8th day of March,
1892, to locate, fix and determine and elect a County
Seat in and for Dickens County, Texas, and the pre-
siding officers of election will open the Polls attheir several election precincts on the day afore-
mentioned to receive the vote cast for the location37
