order was nudo on the duplication ot the
State Trust company of New York pre-
sented by Frank Hagorman lis attorney

receivers himself 13 h Martin and flob
crt Ollhiim and Ihe faction of tho Pitts
burg and lull company which secured
tbeli appointment filed a motion asking
that the ease be remanded to tho Jack
ton county circuit court Tho tlmo for
the argument ot ihls motion was not set
but it will probably be later than May I
as Judge Philips will tako a vacation at

under Judge Philips ordcrB nnd at his

Tho application for the removal of the
case to tho Federal court was mado un-
der the local prejudice act the chargo
being that there would be a prejudice In
Kansas City or Missouri courts against

becauso that company Is a foreign cor-
poration Tho petition presented by Mr
Hacermau sets forth also that all the
receivers appointed by the lower court
would be dominated bv A 13 Stllwell
president of the railroad company that
tho officers of tho railroad and County
Judge Gibson had arranged In advance for
tho appointment of receivers that tho
whole suit was fictitious and filed to pre-
vent the case from going Into th Federal
court so that tho railroad officials could
make the case one ot local Interest and
opposed to the foreign company
Yesterday the State Trust company
brought suit In the Federal court to fore-
close the JJ2000000 mortgage It held
against tho railroad asked that n re-
ceiver bo appointed to protect the bond-
holders and that an Injunction be granted
to prevent the present receivers trom
taking any action In tho meantime As
Judge Philips was III no action was taken
by the court
