Section 3 It shall be the duty of the Mayor from tune to time to make
such recommendations to the Council as he may deem to be for the welfare
of the City and on the second Monday in January of each year or as soon
thereafter as practicable to submit to the Council his annual budget or esti
mate of the receipts and expenses of the City for the current fiscal year
each item in which may be increased reduced or omitted by the Council
Section 4 It shall be the duty of the Council on the third Monday in Janu-
ary of each year or as soon thereafter as practicable to appropriate such
sums of money for each of the various departments of the City government
as it may deem necessary for the maintenance and operation thereof during
the current fiscal year The current fiscal year shall begin at 12 oclock noon
on the first day of January of each year
v In addition to the departmental appropriations herein provided for the
Council shall also make such appropriation for contingent purposes as may-
be deemed necessary
The appropriations herein provided for shall be based upon estimates sub-
mitted by the Mayor in his annual budget provided the same shall have
been submitted to the Council as herein provided
Section 5 The head of each department shall make a written repoit to
the Mayor not later than the first Monday in January in each and every year
showing the operation of such department for the preceding year These re-
ports shall be transmitted to the Mayor together with the estimates sub-
mitted to the Mayor for the current fiscal year and both shall accompany
and be made a part of the Mayors report and budget to the Council
Section 6 The Mayor shall also make such recommendations to the Conn
cil concerning the increase or decrease of the departmental estimates as in
his judgment may best subserve the interests of the city
The Council in making up the budget allowances for any current year
shall first make provision for the payment of interest and the creation set-
ting aside and preservation of a legal sinking fund upon all of the oustandins
legal indebtedness of the City and make provision for the maintenance of the
public school system in accordance with the law governing the public school
system of the City and shall then make such appropriations as the remain-
ing revenues of the City may justify to be appropriated among the respective
departments or otherwise appropriated for public uses as to the Council may
seem best provided however that in no case shall the entire appropriation
jro made including that for interest and sinking fund on the bonded debt and
appropriation for all other public uses and purposes ever exceed the estimated
available resources which shall be based upon the probable revenue of the
City derived from ad valorem taxes unon the basis of the total valuation of
the property for taxation for the preceding year and of such other contingent
revenues of the City as will probably accrue
Section 7 The Council shall have the management and control of the
finances of the City except as otherwise herein provided They shall have
the power to appropriate money and provide for the payment of debts and
expenses of the City to provide by ordinance special funds for special pur-
poses and to make the sanie disbursable only for such purposes and to im-
pose proper penalties for enforcing the same and to this end the Council is
authorized and empowered to receive gifts or donations from individuals
firms or corporations for streets and other public improvements or for any
other legitimate purpose and such gifts or donations shall not be used for
any other purpose than that for which they were given
Section S It shall be the duty of the City Council to cause the City Sec-
retary each month to make a complete and detailed statement for the preced-
ing month of all moneys received by the City and all expenditures made by
it classifying each receipt and expenditure under the proper head showins
from where the same was received and for what the same was expended Said
statments shall be recorded by the City Secretary in a wellbound book kept
by him for that purpose known as the Receipt and Expenditure Book and
said statement and its record shall be open at all times during office hours
of the City Secretary to public inspection and the City Secretary shall upon
application of any newspaper published in the City of Palestine exhibit to
such newspaper any monthly statement which may be published at the
election of such newspaper Within a month after the endof each fiscal
year the City Council shall cause to be published in a daily newspaper pub-
lished in the City of Palestine a full and complete summary statement of all
moneys received and expended by each of the departments of the City and
the sources from which received and the purposes for which expended
Section 9 The Qouncil shall by ordinance adopt such rules and regulations
for its government and order of business as its members may deem best It
may punish members or other persons during its sittings by fine for disor-
derly conduct or contempt
Section 10 The Mayor each Commissioner and the City Secretary shall be
and each of them is hereby authorized to administer oaths or affirmations in
any matter pertaining to the municipal affairs and government of the City
Section 11 Neither the Mayor or any member of the City Council nor any
elective or appointive officer ofthe City shall be directly or indirectly inter-
ested in any work business or contract the expense price or consideration of
which is paid by the City or any of its departments or by any assessment
levied by ordinance or resolution o f the Council nor be the surety of anv
person having any contract work or business with the City for the perform-
ance of which security may be requiied nor be the suretv on the official
bond of any other officer of the City No member of the School Board shall
he at any time during his term of office directly or indirectly interested in
or sin the employ of any school book publishing or school supplying or fur
nishing company or concern or school furniture company or concern All
cntracts in violation of the provisions of this section shall be void and a
violation of the provisions of this section shall ipso facto render vacant the
office
Section 12 No officer or employe of the City shall accept or receive di-
rectly or indirectly from any person firm or corporation operating within the
territorial limits of the City any interuiban railway street railwav gas works
water works electric lights or bower plant heating plant telegraph line tele-
phone line or exchange railroad or any other business using or operatinc
under a public franchise any frank free ticket or free service or accept or
receive directly or indirectly from any such person firm or corporation any
service upon terms more favorable than is grafted to the public generallv
Any violation of the provisions of this section shall ipso facto render vacant
the office of the person violating it
Section 13 The City Council shall meet in rpsnilar session at least twice
each month at such times as shall be fixed by it at the City Hall to consider
and take under advisement and act upon such business as may come before
it Amajority of the Council shall constitute a quorum for the transaction
of business but no action of the Council shall be effective unless upon a vote
of a threefourths majority of the Council Should more than one member
of the City Council be disqualified to vote upon any matter coming before the
Council it shall be the duty of the County Judge of Anderson countv upon
certificate to such disqualification from the qualified members to appoint
cithers in the place and stead of those disqualified and the person so ap
pointed shall possess the same power and authority with reference to the
particular matters upon which the disqualification arises as the qualified
members of said Council and shall take the same oath of office No final
action shall be taken on anv matter concerning the special department of
any absent member of the Council unless such business has been made a
special order of the day by action at a previous meeting of the Council at
which such member was present or such action is taken at a regular meet
ing of the Council Special meetings may be called bv the Mavor or any
two members of the Council at any time to consider onlv such matters as
shall be mentioned in the call for said meeting and written notice thereof
shall be given to each member of said board but this shall not prevent the
Council from meeting in adjourned session from day to dav and from time to
time as they shall deem for the best interest of the Citv ah sessions of the
Council whether regular or called shall be open to the public
ARTICLE IV
Sec 1 All powers now possessed arid conferred bv this Act on the
City of Palestine shall unless otherwise provided in this charter be exer
cised by a Mayor and three Commissioners who together shall be known
and designated as the City Council all of whom shall he elected as herein
after designated by the qualified voters of the City at large and each of
whom shall not only have the right to vote but must vote on all questions
before the Council except as heieinafter provided If any member of the
Council should fail or refuse to vote on any question his vote shall be re
corded by the City Secretory as a nay vote Three members of the Council
shall constitute a quorum and the affirmative vote of three members shall
be necessary to the adoption of any motion resolution or ordinance or to
pass any measure unless otherwise provided in this Act Upon every vote
the yeas and nays shall be called and recorded provided however that no
member of the City Council shall ever he allowed to vote upon the granting
smendlng or changing of any franchise or upon any contract with any per
son or company holding a franchise in which said franchise or contract such
member of the City Council may be directly or indirectly interested and
tnis applies also whenever such member may he directelv or indirecteiv in
trested in the ownership of Mich franchise or securities of such franchise
holder or is in the employment of such company or person
Section 2 The council shall have and possess and the council and its mem
bers shall exercise all executive legislative and judicial powers and duties
now had possessed and exeicised by the Mayor Citv Council Citv Secretarv
City Tax Assessor and Collector City Maishal City Engineer Judse of the
Corporation Court City Physician City Treasurer and Citv Attorney and all
ether executive judicial and administrative officers of the Citv until
changed by a vote of the people
Section 3 The executive and administrative
powers authority and duties
of the Council shall be distributed into and among four departments as fol
lows

Department of Police and Public Safety

Public Affairs and as such shall have the general supervision and oversight

his special charge the enforcementifpf all police and health regulations of the

have supervision of the City HeaHlLofficer and his employes He shall su-
perintendent the purchase of all property and appaiatus needed or used by
the Fire Department of the City and shall see to the enforcement of all fire
ordinances It shall be his duty fofsee to the enforcement of all laws and
ordinances peitaining to the publfqlhealth and safety of the inhabitants of
the City He shall perform suchiotner3duties pertaining to public health and
safety as may be prescribed by ordinance
Section 9 There shall be a firerdfepartment to consist of a chief an assist-
ant chief and such subordinatesfasimay be deemed necessary The chief
shall be appointed by the Mayorjy ithtthe approval of the Council and the

seat file with the City Secretary and cause to be published in a newspaper
published in the City of Palestine a sworn statement of all his election and
campaign expenses and by whom such funds were contributed the amount of
each contribution and to whom the same was paid for election and campaign
purposes and the amount paid to each person and for what purpose
Section 7 The Mayor and each Commissioner shall before entering upon
the duties of his office take the oaih prescribed by the constitution of thp
tate of Texas that he will faithfully discharge the duties of his office and
all other officers of the City shall take such oath of office as may he pre-
scribed by he City Council
ARTJqLE VI
Section 1 Qualification of Officers The Mayor and each Commissioner at
the time of his election to office snail be at least twentyfive years of age
and shall have resided in the City offealestine for not less than thiee consecu-
tive years next preceding the dayol election and must be a taxpayer and
qualified voter of the City of Palestine
ARTICLE VII
Section 1 Term of Office The te rii of office of Mayor and Commissioneis
shall be two years from date of election and until their respective succes-
sors are elected and qualified excepLin case of an election to fill an unex
pired term when the term of office shall be for such unexpired term
ARTICLE VIII
Section 1 The City Council shallxat the beginning of its term of office
elect by ballot by a majority vote of all the members thereof one of their num-
ber as Mayor pro tern and the Commissioner so chosen shall bo invested
with all the powers and shall perform all the duties of Mayor during the
Mayops absence sickness or other inability to act
Section 2 In case of the death resignation or permanent disability of the
Mayor or whenever a vacancy in the office of Mayor shall occur for anj
reason the Mayor pro tern shall act as Mayor and shall possess all the
rights and powers of Mayor and perform all the duties and receive the salarv
of Mayor and none other under the official title however of Major pre
tern until an election is held to fill such vacancy Whenever a vacancy shall
occur in the office of Major or Commissioner the City Council shall imme
diately order a special election for the office of Mavor or Com-
missioner which election shall be held within thirty days thereafter Said
special election shall be governed in all things by the provisions of Article
5 of this Act except as to the day of holding such election
ARTICLE IX
Section 1 The compensation of the Mayor shall be 750 per year payable
in equal monthly installments and he shall give bond payable to the Citv
of Palestine in the of Five Thousand

may be requiied by ordinance forthe faithful performance of the duties of
his office
Section 2 The compensation of each Commissioner shall he 500 per year
payable in equal monthly installments and each Commissioner shall give
bond payable to the Mayor and hisjsuccessors in office in the sum of Five
Thousand Dollars or such larger sum as may be requiied bv ordinance for
the faithful peiformance of theduties of his office
Section 3 The Mayor shall nominate all appointive officers of the City of
Palestine except as hereinafter provided and such nominations shall be sub

ject to the confirmation of the City Council by a threefourths vote thereof
The Mayor shall not be entitled to vote as a member of said Council upon
the question of the confirmation of any nominations for office made by him
Section 4 Each member of the Council shall have the right to propose and
nominate all officers and employes in the department under his immediate su-
pervision unless otherwise provided herein but all such nominations and ap
pointments shall be subject to the confirmation of the City Council by a
threofouiths vote thereof The Commissioners shall not vote upon the con
firmation of their respective nominees
Section 5 Xo appointive office or employment shall be for a longer period
than two years but any appointive officer or employe may be removed or
discharged from his office or employment at any time by the officer appointing
him with theappi oval of the Mayor or by a threefourths vote of the Coun-
cil All salaries and wages for appointive officers and employes ot the City
unless otherwise herein provided shall be fixed and paid by the City Council
acting as a whole and shall not become effective unless at least three mem
bers of the council shall vote therefor The salaries of such officers and
employes may be increased or decreased at any time by a vote of at least
three members of the Council
Section C The City Council shall have the right by a threefourths vote
of all the members thereof to create such new offices or employments as may
in their opinion be necessary for the welfare of the City and impose such
duties upon the holders thereof as they may see proper and the City Council
may abolish at any time any office or employment so created by them by a

Section 7 Nominations for appointiye offices and employments shall be
submitted by the Mayor and respective Commissioners at the first regular
neoting of the Council after their

ifter as practicable which nominations shall be promptly acted upon
Section S In case of a vacancy in any appointive office or employment
rhe appointing officer shall immediately nominate some suitable person to
ill the unexpired term of such vacancy and submit his name to the Council-

by the Council the appointment shall take effect from the date of such con
lrmation In the event the Council should refuse to confir msuch nomination
the appointing officer shall nominate another and different person for said v
jffice and shall continue to do so until a nomination made by him for said
office is confirmed by the Council
Section 9 The City Attorney shall be a qualified voter of the
City of Palestine and shall have resided in the said City at
least three consecutive years before his appointment and shall be
i regularly licensed and practicing attorneyatlaw He shall be nominated
by the Mayor and confirmed by the Council as hereinbefore provided He e
ihall receice for his services such compensation as may be fixed by the City
Council and shall hold his office until his successor is appointed and qualified
He shall represent the City in all litigation and controversies It shall be his
duty to pass upon all proposed ordinances granting franchises of any kind
md in the event of his disapproval of any of such ordinances it shall be his
duty to file with the City Council his written legal objections thereto It shall
be his duty to inspect and pass upon all papers documents contracts and
other instruments in which the City may be interested He shall be the legal
advisor of the Mayor of the Superintendents of the different departments
and of the City Council and School Trustees or any committee thereof
and of all city officers and employes with respect to any legal question in-
volving an official duty or any other matter pertaining to the affairs of the
City of Palestine He shall perform such other duties as the City Council
may direct Whenever it shall be brought to his knowledge through the affi
davit of ten creditable persons that any person firm or corporation exercising
md enjoyjng any franchise or privilege from the City of Palestine has been
uilty of a breach of any condition of such franchise or privelege or has1
failed to comply in any material manner with the terms and stipulations
thereof it shall be his duty to report the same to the City Council together
with all facts bearing upon the same which may be brought to his attention
Cf the City Council shall determine that said complaints are well founded It
shall be its duty to take such action as may be necessary and in the event
the offending corporation person or firm shall fail or refuse to conform
to the orders of the Council in respect thereto it shall be the duty of the
Council to direct the City Attorney to institute suit in the court having juris-
diction thereof against such corporation firm or person for a judgment of
orfeiture of franchise or privilege or any other judgment proper under the
premises It shall he his duty to see that all penal ordinances of the City
are impartially enforced Whenever deemed expedient the City Council may
imploy other attorneys
Section 10 The City Secretary shall be a qualified voter of the City of
Palestine and shall have resided in said City for at least three years next
preceding his appointment He shall be nominated by the Mayor and con-
firmed by the City Council as hereinbefore provided He shall receive for
lis services such compensation as may be fixed by the Council It shall T > e
his duty to attend all meetings of the City Council and to keep accurate
minutes of the proceedings thereof and to record the same in a book or
books provided for that purpose to preserve and keep in order all hooks
papers and documents records and files of the Council to countersign all
commissions and licenses issued by the Mayor to keep a record of all such ito
to draw all warrants on the Treasurer or other proper officer of the fiity

form such other and further duties as may be required of him either by law
or by the City Council by ordinance or 6therwise He shall give bond pay-
able to the Mayor and his successors in office in the sum of 2000 for the
faithful performance of his duties He shall have custody of all ordinances
of the City and of papers and records of the City Council and of the seal of
the corporation and shall affix the same to only such documents and obliga
tions of the city as he may be legally authorized so to do
Section 11 The City Tax Assessor and Collector shall be at least twenty
one years of age and shall have resided in the City of Palestine at least three
years next preceding his appointment He shall be nominated by the Super-
intendent of the Department of Receipts Disbursements and Accounts and
confirmed by the Council as hereinbefore provided He shall receive for his
services such compensation as may be fixed by the City Council He shall
give bond in the sum of 25000 or in such amount above the same as may
be prescribed by the City Council with good and sufficient sureties said bond
to be payable to the Mayor and his successors in office The Council may
require a new bond of him at any time if in its opinion the existing bond
is insufficient and whenever such new bond is required he shall perform no
official act until such new bond shall be given and approved He shall he
directly responsible for the performance of all duties relating to his office to
the Superintendent of Receipts Disbursements andAccounts He shall assess-
or cause to be assessed all taxable1 property in such manner and within such
time as the Council may prescribe He shall make duplicate assessment rolls
and on their completion and approval by the Superintendent of Receipts Dis-
bursements and Accounts he shall deliver one copy to such Superintendent
and retain one for his own use in making collections He shall cause prop-
erty holders to render their property for taxation in the manner prescribed
by law or ordinance and for this purpose he is empowered to administer oaths
and affirmations He shall collect all taxes due the city whether the same
be general special school occupation license or otherwise and shall pay
the same over to the City Treasurer or the Treasurer of the School Board as
the case may be within six days of their collections taking duplicate receipts
therefor one of which he shall retain and the other he shall turn over to
the Superintendent of Receipts Disbursements and Accounts provided how-
ever he shall never be entitled to keep on hand a sum exceeding 1000 He
shall monthly or oftener if requiied make a detailed report to the City
Council of all collections made by him He shall be vigilant and see that no
business is carried on unless the license or occupation tax due thereon shall
have first been paid He shall have such deputies as may be given hftn by
the Council said deputies to be nominated by the Sunerintendent of Receipts
Disbursements and Accounts and confirmed by the Council in the manner as
hereinbefore prescribed The Tax Assessor and Collector and his deputies
shall he responsible to the Superintendent of Receipts Disburesements and
Accounts for all official acts done by them When any assessment for taxes
is increased decreased or changed by the City Tax Assessor or
Board of Equalization froni the assessment rendered by the owner of the
property or his agent he shall cause notice to be given to the owner of such
property or the agent by whom the same was assessed of the change in-
crease or decrease so made by mailing notices to such person or his said
agent if the postoffice address of such person or his agent is known and
shall give further notice by publication for one day in some newspaper pub
lished in the City of Palestine and in such newspaper publication the names
of all owners of property so changed or increased shall be given if known
and if the name of the owner is unknown it shall be so stated and a sufficient
description of the property given to identify it and the notice by publication
either as to unknown owner or unknown postoffice address shall alone be
sufficient
Section 12 If the City Tax Assessor and Collector should fail to deposit
taxes collected by him as provided in the preceding section he and the sure-
ties on his bond shall be liable and required to pay interest at the rate of ten
per cent per a nnum on such money until deposited and for anv such viola-
tion of his duty he shall he immediately suspended from his office by Super-
intendent of Receipts Disbursements and Accounts until the deposit is made
by him together with interest due thereon and during such suspension from
office he shall receive no salary The City Tax Assessor and Collector may
be either a man or a single woman
Section 13 The office of City Treasurer shall be let by contract to the
highest and best bidder in the discretion of the Citv Council and in deter-
mining the highest and best bidder the highest rate of interest to be paid
upon daily balances shallhe the criterion that shall decide The Superintend-
ent of Receipts Disbursements and Accounts shall iramediatelv upon being
assigned to such superintendency advertise for bids for the office of City
Tieasurer for a period of tenconsecutive days in some dailv newspaper pub
lished in the City of Palestine stating what said bids shall specifv and the
teims on which said bids shall be received including the rate of interest on
daily balances He shall also mail to each Bank In the Citv of Palestine with
in said ten days a copy of said notice On the tenth day Sundavs and legal
holidays excluded utter the first day of such advertisement said bids shall be
opened and examined by the City Council The date of the opening of said
bids shall he specified in the abovementioned notice At the next re < nlar
meeting of the Council after the bids are opened or if the day upon which
said bids are opened is a regular meeting day the Council shall proceed to
pass upon said bids and elect a City Treasurer who shall hold his office for
a period of two years and until his successor is elected and qualified The
City Treasurer so appointed shall be deemed for all purposes an officer of
the City and shall be under the direct supervision of the Superintendent o
