Dear Sir Tho members of the railroad

Instructive letter of tho 1Mb Instant with
much Interest We have not been able to
answer It sooner on account of the con-
stant pressure on our time growing out
of a number of official incstlgallons
Tho facta you stato are most persuasive
as to the necessity of the Improvement
of the navigation of the Trinity river
and wo fully agree with you as to the

We believe tho Improvement of the navi-

Q DUKE CRAWFORD vs HOUSTON
AND TLXAS CENTRAL RAILWAY
COMPANY suit against the railway
company to recover damages for per-
sonal Injuries alleged to have been re-
ceived by the plaintiff whllo ho was In
the employ of Its receiver Dillingham
from Harris county First district Re-
versed and rendered
Crawford was a watchman At the
time of tho accident ho had entered be-
tween two cars for tho purpose of un-
coupling them Finding tho coupling pin-
to bo fast ho signaled tho engineer
to back the train and continued to walk
along tho track between tho cars at
tempting to unfasten tho pin Walking
In this manner his foot became fastened
between tho rails of a switch and hit
was thrown down receiving the Injuries
complained of There was a verdict and
Judgment In tho trial court for tho plain-
tiff and hla damages wero llxed nt 10
OW This Judgment was reversed and r
mnndeil by tho court of civil appeals
1 Negligence is usually a question of
fact for the Jury but when tho facts havo
b jn ascertained and definitely settled
It becomes a question of law as to
whether or not tho facts so found aro
suuklcnt In law to establish tho fact of
negligence
We have carefully considered this ques-
tion upon tho lacts as prcecuted utui wo
bellevn that the court of civil appeals
lightly held that the plnlntllt was guilty
of such nogiiirence na to bar him from
u iccovery In this case The negligence
tviii so manifest und so clearly estab
lPdied by his own evidence that a ver-
dict In Ilia favor could not properly bo
sustained by the court
At the time when plaintiff entered be-
tween the cars after they had been put
In motion by his own signal ho know
that tho pin In the drawhead was fas-
tened that ho wns going In the direction
of the switch within a sliort dlstanco ot
It and he fully understood the danger of
approaching tho switch whllo between
tho cars Suoh being the state of facts
ho assumed tho risks attending the per-
formance of the service and by continu-
ing tire work under the Imminent dan
gr wus guilty of contributory negli-
gence which was tho proximate cauto
of the Injury received and thercforo
can not recover tGU Texas 737
2 Plaintiffs right to recover against
tho defendant In this case dopended upon
the fact that Improvements wero made
by tho receiver after the sale and convey-
ance by tho application of earnings aris-
ing subsequent to said sale It was
therefore necessary for him to allego
and provo tliofe facts to entttlo him to
a Judgment against tho defendant
The Judgment is reversed nnd rendered
In favor of the defendant below

CITY OF SAN ANTONIO vs T II
M1CKLEJOI1N certified question In a
caro from Bcxnr county Fourth dis-
trict Answered In favor of defendant
In error Mlcklejohn
This suit wns Instituted by Mlcklejohn
against the city tit San Antonio to recover
a sum of mency alleged to bo duo the
plaintiff as Ids salary Incident to tho of
llce of superintendent of public works
In 1WI thu council of tho city by ordi-
nance created tho office of superintend-
ent of public works und plalntlll below
was appointed thereto The city charter
provides that tho style of city ordinances
shall be Be It ordained by tho city
council of the city of Salt Antonio
Subsequent to tho passage of the ordi-
nance and appointment of Mlcklejohn tho
following lesolutlon wns passed by the
city council Bo It resolved that the
oltlce of superintendent of public works
It hereby abolished to dato from July
31 1SSI
yhestlon 1 Tho offlco having been
created by ordinance could It bo
abolished by a resolution and was It the
effect of the resolution to abolish suld
office
Wo aro of tho opinion that the resolu-
tion did not operate as a repeal of the or-
dinance creating tho office of superin-
tendent of public works
The council is only authorized to
legislate under tho forms and in tho mnn
ner prescribed by tho law of Its creation
The eaence ot a law Is tho solemn ex-
pression of tho will of the lawmaking
power upon lt subject matter nnd It
would seem that the expression of n
command though in tho form of a teso
Ititlon should be deemed valid aa nn ordi-
nance oven where the charter requires
the council to legislate by ordinance pro-
vided It lie passed In conformity to the
other requirements nf tho act of Incor-
poration
The Intent of the council is clearly
munlfeslell In the resolution but tho dlf
llculty which presents Itself Is that their
will Is not expressed In tho modo re-
quired by tlie charter In order to make
a valid law
It is provided by the charter that all
oiiIccm shall bo created by ordinance It
takes a law to repeal a law Tho net
which destroys should be of equal dig-
nity with that which creates A resolu-
tion proper Is not Inw A legislative
body may In that form express an opin
ion may govern Its own procedure with-
in the limitations Imposed upon It by Its
constitution or charter and In caso It
him ministerial functions may direct
their performance but It can not adopt
that modo of procedure In malting laws
where tho power which creates It has
commanded that It shall leglslato In a
dllferent form
Tho question Is answered In tho nega
t Ive
IveQuestion
Question 2 Is tho plaintiff entitled to
recover the salary of the office up to tho
20th day of March 1KI3 If the offlco was
not alwllshcd by tho resolution
From what lias been said above It fol
lows that plaintiff below was do Jure
tho superintendent of public works of
the city The term of office having been
llxed bv tho ordinance which created tho
office ft was controlled by the provision
of tho constitution which limits tho term
of all offices not therein prescribed to
tho period of two years Con article
16 section 30 If the dutlo1 of the of
llco were not performed wo Infer from
tho facts stated that It was through no
fault of tho plaintiff He was willing to
perform them Under such circumstances
lie was entitled to demand and rccelvo
the salary affixed to his office
The second question Is answered In tho
affirmative
