STATUS OF 21.06
Following the recent decision of the Texas Supreme Court to
not strike down the Texas sodomy law, there is a great deal
of confusion in our community about the exact. status of
21.06. In an effort to clear up such confusion here is a
brief explanation excerpted from the January 19th edition of
The Texas Triangle.
For a variety of complex reasons, five of the nine .justices
said the court does not have jurisdiction to make a decision
on the 21.06 case that was before them, so in a sense they
did nothing. However, they let stand a lower appeals court
ruling; that ruling did strike down the sodomy law, and
attorneys can cite it in the future.
The lower court ruling does not carry the same power that a
Supreme Court decision would have. The fact remains that
the highest court in the state has yet to rule definitively
on the sodomy statute. Yet, every court that has ever
considered 21.06 on its merits has struck it down as
unconstitutional.
The sodomy law is still a part of the Texas Penal Code, but
there is now a notation made in the yearly updates to the
law books that the law has been ruled unconstitutional.
Usually, but not always, the Texas Legislature strikes laws
from the books that have been declared unconstitutional.
State Representative Glen Maxey has stated that he will
again fight to have 21.06 removed from Texas law in the next
legislative session.I
