Page 55. Q (by Mr. Barber). Isn't it a fact that with regard to some of
the Village Station cases you authorized Winfield Scott to move
to dismiss one or more of these cases from one of the courts
and refile them in Judge Ellis' court?
Henry Wade. Not Judge Ellis' court, but to refile them. They
were - I don't know where they were refiled but they were --
Ended up trying all five of them, but they are in different
courts.
Mr. Barber. Why did you do that?
Mr. Wade. Mainly because we didn't think we got a fair trial on
them before Judge Miller.
Mr. barber. You didn't think the State got a fair trial?
Mr. Wade. Yeah.
Page 58. Q (by Mr. Barber). Why did you conclude that the county would not
get a fair trial in Miller's court?
Page 59. Mr. Wade. We. didn't think we got a fair trial in the court because
we had five witnesses to a crime and he found them not guilty of
public lewdness.
Mr. Barber. There were other witnesses that testified it didn't
occur; were there not?
Mr. Wade. Couldn't anybody testify it didn't occur. Some testified
they didn't see it occur, but I guess the defendant testified it
didn't occur.
Mr. Barber. And all the witnesses who testified it did occur were
police officers; is that correct?
Mr. Wade. Yes, five witnesses, four or five. I'm not sure how many..
