made the decision, selected Ellis' court?
Mr. Wade. I didn't select it. I don't think he did, if they were
filed in Ellis' court... .Nobody selected Ellis' court, or I didn't.

Page 285. Winfield Scott. I told you already Mr. Wade instructed us to file
them in Judge Ellis' court and that is what apparently was done
-- and was done.
Mr. Mason. Directing your attention back to February or March of
this year, did the Vice Squad or any member of the Vice Squad
ever contact you about getting those cases out of Chuck Miller's
court'and this case in particular?
Winfield Scott. Not this case in particular. The officers were very
upset about the fact that Judge Miller had found these two defen-
dants not guilty.
Mr. Mason. And that's what you aver in that motion*, isn't it, that
there had been two acquittals and you're asking the Court because
the acquittals rose from the same time, same place and location that
the case should be dismissed?
W. Scott. Yes.
Page 283. Q (by Mr. Mason). Was it your idea to refile the case against Richard
S.?
Winfield Scott. It was Mr. Wade's direction.
Mr. Mason. And you ordered Mr. Street to refile it in Judge Ellis'
court?
W. Scott. Bill Arnold went to Mr. Street and I guess Mr. Brotherton
and instructed them Mr. Wade wanted the case refiled in Judge
Ellis' court.
Page 276. Q (by Mr. Mason). And you signed this instrument*, didn't you?
Winfield Scott. Sure did.
Mr. Mason. Mr. Scott, I'm going to ask you if you became aware of
any details regarding the fact situation that is the basis of
this trial today, that made you refile this case?
W. Scott. I -efiled the case at Mr. Wade's direction.
Mr. Mason. Why was that?
W. Scott. I didn't, Bill Arnold did it, actually.
