I. INTRODUCTORY STATEMENT
The DALLAS GAY ALLIANCE wishes to file grievances against
HENRY WADE, District Attorney of Dallas County, Texas,
WINFIELD SCOTT, Assistant Dist. Attorney, and Chief Prosecutor,
Misdemeanor Courts, Dallas, Texas
and A. W. ('Bill') ARNOLD III, Assistant Dist. Attorney, Misdemeanor
Courts,
for violations of Texas Bar Association Disciplinary Rules
DR1-102(A) (4) of the Code of Professional Responsibility (CPR):
"A lawyer shall not engage in conduct involving
dishonesty, fraud, deceit or misrepresentation.";
DRl-102(A) (5) of the Code of Professional Responsibility:
"A lawyer shall not engage in conduct that is prejudicial
to the administration of justice.";
and of Ethical Canon EC9-4 of the Code of Professional Responsibility:
"Because the very essence of the legal system is to
provide procedures by which matters can be presented
in an impartial manner so that they may be decided
soley upon the merits, any statement or suggestion
by a lawyer that he can or would attempt to circumvent
those procedures is detrimental to the legal system and
tends to undermine public confidence in it."
The violations involve prosecutorial vindictiveness (see Exhibit 'J' attached,
pp. 16 - 19). Specifically,
i) Dist. Attorney Wade and Asst. Dist. Attorneys Scott and
Arnold acted to thwart the course of justice by forum
shopping, in violation of DRl-102(A) (5).
ii) Mr. Wade and the above Asst. Dist. Attorneys acted to
perpetrate a fraud upon the Dallas County Criminal
Courts, in violation of DRl-102(A)(4).I
