The DALLAS GAY ALLIANCE wishes to file a grievance against 'Bob' Phillips,
Assistant District Attorney of Dallas County, Texas, for the following viola-
tions of Disciplinary Rule DR7-106(C) (2) of the Code of Professional Responsi-
bility:
"In appearing in his professional capacity before a tribunal,
a lawyer shall not ask any question that he has no reasonable
basis to believe is relevant to the case and that is intended
to degrade a witness or other person."
On February 27, 1981, during the trial before the court in County Criminal
Court No. 8 in Dallas County, Texas, of Rudy H. (No. M-8012865-J), Mr. Phillips
called officers Paul King and H.K. Sanders of the Vice Division of the Dallas
Police Department to the witness stand. The Statement of Facts documents that
these officers had no independent knowledge -of the defendant Rudy H's reputation,
and acted merly as mouthpieces of the prosecutor, repeating what had been told
to them by Assistant District Attorney Phillips and Winfield Scott. See Exhibit
'F' (Nos. M-80 12864/5-J). The questions asked by Mr. Phillips thus had no re-
levance to the case.

in this case?
Officer Paul King. Yes, sir.
Mr. Phillips. Would you point him out to the judge, please?
Officer King. It's the man in the blue blazer.
Mr. Phillips. All right. Two (2) over from me?
Officer King. Yes, sir.
Mr. Phillips. Are you acquainted with the general reputation of
Rudy H. in the :community for truth and veracity?
Officer King. Yes, sir.1
